CHAPTER 819.

AN ACT in relation to the road law of Fayette county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That an act, entitled, "an act to amend the road law applicable to Fayette and Scott counties," approved March 1st, 1854, be and the same is hereby repealed so far as its provisions are applicable to the county of Fayette. § 2. This act shall take effect from its passage. Approved February 13, 1863.

CHAPTER 820.

AN ACT to authorize the use of the Rockcastle county jail by the county of Laurel,

Whereas, it is represented to this General Assembly that the Laurel county jail was sometime since destroyed by fire, and that owing to the recent invasion, and the disturb ed condition of the country, that said county has been unable to construct another jail building, so that said county is without any suitable place for the incarceration of criminals and other persons--for remedy whereof,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That said county is hereby permitted and authorized to use the jail of Rockcastle county, in all cases where it is necessary to incarcerate any person or persons as provided by law; and the jailer of Rockcastle county is hereby directed to receive and safely keep all persons commited to said jail by the proper authorities of Laurel county; and for so doing he shall receive the same compensation as now provided by law for similar services in his own county; and this allowance shall be made for such servi ces whether rendered before or after the passage of this

act.

§ 2. This act shall take affect from and after its passage. Approved February 13, 1863

CHAPTER 821.

AN ACT providing for the unpaid taxes due for the year 1862 from the county of Boyle.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for G. W. Doneghy, sheriff of the county of Boyle, to proceed to collect, by distress or otherwise, as allowed by law, the additional tax of

ten cents on the one hundred dollars worth of taxable property imposed by the recent acts of this General Assembly, due from the tax payers in said county for the year 1862, and which he failed to collect in proper time, because, as represented by him, he was not apprized of the passage of said acts when engaged in the collection of the revenue due from said county.

§ 2. The said sheriff shall collect and pay said additional tax into the public treasury on or before the first day of August next.

3. This act to take effect from and after its passage.

CHAPTER 822.

AN ACT to establish an additional voting precinct in Hickman county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That all that portion of district No. 3, lying north of the Obion creek, in Hickman county, is hereby made and constituted a voting precinct.

§ 2. That said district shall be governed by the general laws in relation to voting precincts now in force.

3. The place of voting in said district shall be at Peio. § 4. This act shall be in force from and after its passage. Approved February 13, 1863.

CHAPTER 823.

AN ACT authorizing Kentucky University to loan out its funds. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall and may be lawful for the Board of Curators of Kentucky University to loan out any of the funds belonging to said university, upon mortgage or other security, at any rate of interest that may be agreed upon, not exceeding the rate of ten per cent. per annum.

§ 2. This act shall take effect from and after its passage. Approved February 13, 1863.

CHAPTER 824.

AN ACT for the benefit of Stitt & Campbell, of the county of Nicho las.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That Hugh M. Stitt and Leonidas Campbell, hotel keepers, in the town of Carlisle, county of Nicholas, are hereby authorized to keep their tavern bar in the family grocery store of said Stitt & Campbell, on front street, in Carlisle, about ten steps from their tavern house: Provided, This privilege shall only continue during the continuance of their tavern license, and that they shall be subject to all the penalties of the law for keeping a disorderly house, upon being convicted thereof.

§ 2. This act to take effect from its passage.

CHAPTER 825.

AN ACT for the benefit of M. M. Lyon, late sheriff of Lyon county. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That M. M. Lyon, late sheriff of Lyon county, and he is hereby released from all damages for which he and his sureties are, by law liable, upon two judgments of the Franklin circuit court against him and his sureties, the one for thirty-eight hundred and fifty dollars and fifty-six cents, with interest from the 1st day of June, 1859, and seven dollars and fifty-four cents cost, and the other for thirty-four hundred and twenty-five dollars and sixty-four cents, with interest from the first day of June, 1858, and eight dollars and fifteen cents costs, for balances of reve nue which he failed to collect and pay over in accordance with law for said years, it appearing that such failure was the result of his misfortune and not of any culpable neg lect of duty; Provided, That said M. M. Lyon, or some one for him, shall pay, or cause to be paid, to the proper officer, within ninety days from the approval hereof, the balance of the principal, interest, and costs, upon said judgment. § 2. This act to take effect from its passage.

CHAPTER 826.

AN ACT for the benefit of the Sinking Fund of the Louisville and
Nashville railroad for Hart county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the county court of Hart county, a majority of the justices of the peace in commission, and the presiding judge of said county being present, and composing the court, are hereby authorized, at any time, to fill any vacancy that may now or hereafter exist in the board of sinking fund commissioners for said county, which commissioners shall have all the powers conferred by the act incorporating the Louisville and Nashville railroad company, and the amendments thereto, under which said board was originally organized.

§2. That all the appointments of commissioners of said board, heretofore made by the county court aforesaid, whether composed as aforesaid or not, are hereby legalized.

§3. That the presiding judge of said county is authorized, at any time, to summons up the justices of the peace in commission in said county, to hold a court for the purposes aforesaid.

§ 4. This act to take effect from and after its passage.

CHAPTER 829.

AN ACT for the benefit of the sheriff of Whitley county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§1. That the sheriff of Whitley county is hereby authorized and empowered, should he be unable to make sale of a runaway slave named Dennis, at the court-house of said county, on a court day, as now required by law, to sell said negro, at any other most suitable place in said county, C at such time as may be most convenient, first giving due notice of the time and place of making the sale, as now required by law, at least fifteen days before the day of sale, and shall make such sale at the most suitable public place in said county when he can safely do so.

§ 2. This act shall be in force from its passage.

CHAPTER 830.

AN ACT for the benefit of R. L. Ellison, late Clerk of the Calloway
Circuit Court.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That R. L. Ellison, late clerk of the Calloway circuit court, be and he is hereby allowed the further time of two years from the passage of this act to collect any uncollected fee bills due him as clerk aforesaid: Provided, That said clerk shall be liable to all the penalties imposed by law for issuing and collecting illegal fee bills. § 2. This act to take effect from its passage.

CHAPTER 831.

AN ACT to amend an act, entitled, an act to amend the charter of the city of Paducah.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the 6th section of an act, entitled, "An act to amend an act, entitled, an act to amend the charter of the city of Paducah," approved February 5th, 1858, be and is hereby so amended so as to make it lawful for the city judge to hold his civil court in the same house in said city in which he holds the police courts.

§ 2. This act to take effect from its passage.

CHAPTER 832.

AN ACT to amend an act, entitled, an act to provide a more efficient
Police Department in the city of Louisville.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That that part of the 15th section of an act approv ed March 1st, 1860, entitled, an act to provide a more efficient police department in the city of Louisville, (chapter 852,) which prohibits policemen in the city of Louisville from receiving pay as witnesses in felony prosecutions in the circuit court of Jefferson county, be and the same is hereby repealed.

§ 2. This act to take effect from its passage.
