CHAPTER 979.

AN ACT to change the time of holding the Edmonson County and Quarterly Courts.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That hereafter the several county courts for Edmonson county shall commence and be held on the second and gr. courts Monday in each month; and the several quarterly courts for said county shall commence and be held on the second Tuesday in each month, in which said courts are now required by law to be held, instead of the times now specified by law.

§ 2. That it shall be the duty of the jailer of said county Jailer to attend to attend upon said court, and to perform the same duties as required by law when in attendance upon circuit courts, for which he shall be allowed a reasonable compensation, Compensation. to be certified by the judge, and paid out of the county levy as other claims against the county.

§ 3. This act to be in force from and after the first day of April next.

CHAPTER 980.

AN ACT giving certain officers, elected in 1862, further time to execute bond and take the oath of office.

Whereas, Many officers who were elected in 1862, have been unable to take the oath of office and give bond within the time required by section 12, chapter 71, Revised Statutes, owing to the disturbed state of the country, and the presence of the rebel forces in many of the counties of the Commonwealth-for remedy whereof,

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the further time until the 1st day of April next, be and the same is hereby given to all persons elected to office in any of the counties of this Commonwealth, to take the oath and execute the bond required by law; and ail such oaths taken and bonds given under this act, or previous to this time, shall have the same effect as if they had been taken and given in the time required by the sec

tion aforesaid.

§ 2. That where any person was elected to office and failed to give the bond and take the oath in consequence of the reasons assigned in the preamble to this act, such person shall not be held ineligible to office.

§ 3. That where an office became vacant and that vacancy has been filled according to law, this act shall not be construed to authorize the person who was elected and failed to comply with the provisions of the section aforesaid, to take said office.

§4. This act shall take effect from and after its passage. Approved March 2, 1863.

CHAPTER 983.

AN ACT to prevent certain negroes and mulattoes from migrating to or remaining in this State.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall not be lawful for any negro or mulatto claiming or pretending to be free, under or by virtue of the Proclamation of the President of the United States, dated the 1st of January, 1863, declaring free slaves in certain States and parts of States, or any similar proclamation, by order of the Government of the United States, or any officer or agent thereof, to migrate to or remain in this State.

§ 2. Any negro or mulatto who shall violate the provisions of this act shall be arrested, dealt with, and disposed of as runaways, and the proceedings shall conform to the laws in existence, at the time they are had in relation to runaway slaves.

§3. The purchaser of any such negro or mulatto sold under and by virtue of such proceedings shall, by virtue of such purchase, acquire and have the same right to, the same property in, and control over such negro or mulatto as masters have over their slaves under existing laws, subject to the provisions in relation to slaves sold as runaways, and shall in all respects be governed by the law in relation to master and slave.

§ 4. The purchase money for such negro or mulatto shall not be paid into the public treasury until the right of redemption shall have expired or been finally determined by adjudication, in case the same shall be put in litigation, as provided in relation to slaves sold as runaways, and the court shall have power to loan the same, in the meantime taking bond and good security for the same.

5. It shall be the duty of all peace officers to see that the provisions of this act are enforced.

§ 6. This act shall take effect from its passage.

CHAPTER 985.

AN ACT to regulate civil actions against officers and soldiers in the service of the United States and this State.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That in all civil actions in any court of original jurisdiction in this Commonwealth, where it is satisfactorily shown by affidavits or otherwise that any defendant thereto is an officer or soldier in the military service of the United States or of this State, the court shall give such defendant further time to file his answer or make his defense; and no judgment shall be rendered against him by default while he continues in the service aforesaid: Provided, No such officer or soldier who has deserted, or is absent from said service without leave, shall be entitled to the benefits of this act: Provided further, That if any such Proviso. officer or soldier is in the county of his residence at the the time any such action is called for trial, he shall be required to show the fact to the satisfaction of the court, that he is absent from the service with leave, otherwise the case may be tried.

§ 2. That this act shall take effect from its passage, and continue in force for one year only.

CHAPTER 987.

AN ACT concerning the collection of the public revenue for 1863. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the time allowed by the second section of the act, entitled, an act to amend an act, entitled, an act concerning the collection of public revenue and county levy for the years 1861 and 1862, approved August 28th, 1862, for the appointment of collectors of the public revenue and county levy for the years 1861 and 1862, is hereby extended until the 1st day of July, 1863: Provided, That the right given by said act, and the act to which the same is an amendment, to the Auditor, to make said appointment shall remain unimpaired: And, provided further, That should the Auditor make any appointment of a collector bond in co of the revenue in any county for those years, the party or person so appointed may give bond for the same before the county court, instead of before the Auditor, as required by said act-a certified copy of which shall be forwarded to the Auditor.

§ 2. This act to take effect from its passage.

CHAPTER 992.

AN ACT to regulate the time of holding the circuit courts in the 11th
Judicial District.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the circuit courts in the 11th judicial district be held at the times named herein, and continue the num ber of juridical days hereinafter named, if the business require it:

In the county of Montgomery on the 1st Mondays in February and August, and continue twelve juridical days. In the county of Powell on the 3d Mondays in February and August, and continue twelve juridical days.

In the county of Morgan on the 1st Mondays in March and September and continue twelve juridical days.

In the county of Wolfe on the 3d Mondays in March and September, and continue six juridical days.

In the county of Magoffin on the 4th Mondays in March and September, and continue six juridical days.

In the county of Floyd the Mondays succeeding the Magoffin courts, and continue six juridical days.

In the county of Pike the Mondays succeeding the Floyd courts, and continue six juridical days.

In the county of Johnson on the Mondays succeeding the Pike courts, and continue six juridical days.

In the county of Lawrence on the Mondays succeeding the Johnson courts, and continue twelve juridical days. In the county of Carter the Mondays succeeding the Lawrence courts, and continue twelve juridical days.

In the county of Boyd the Mondays succeeding the Carter courts, and continue twelve juridical days.

In the county of Bath on the Mondays succeeding the
Boyd courts, and continue twelve juridical days.
§2. This act shall take effect from and after the 1st of
July next.

CHAPTER 993.

AN ACT giving additional clerk hire to the Treasurer. Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That hereafter there shall be allowed to the Treasurer the sum of five hundred dollars per annum, for clerk hire, instead of the sum of three hundred dollars, as now allowed by law, to be drawn from the treasury in the same

manner in which salaries to public officers are authorized to be paid.

§ 2. This act shall take effect from and after its passage. Approved March 2, 1863.

CHAPTER 995.

AN ACT in reference to the Library.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the Auditor draw his warrant on the treasury in favor of the State Librarian for one hundred dollars; and that the amount thereof is hereby appropriated, to be laid out and expended by said Librarian, under the direction of the board of education, for the purchase of literary and miscellaneous works, to be added to the State Library; and that from and after the passage of this act an additional sum of one hundred dollars per annum is hereby set apart and appropriated, to be drawn from the treasury and expended in the manner and for the purposes aforesaid: Provided, That in all the purchases to be made, as provided in this section, special reference be had to the purchase of such books as relates to the history and literature of this Commonwealth.

§ 2. That the Librarian may, from time to time, with the consent of the Governor, exchange with any State in this books and docuUnion, and with any foreign country, copies of the public books and documents published by this State, for copies of the public books and documents of such other State or country.
