CHAPTER 438.

AN ACT to incorporate the Greenup Union Presbyterian church, of Greenup

county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That James L. Waring, William Biggs, jr., and Thomas Lawson, and their successors, be, and are hereby, created a body politic and corporate, by the name and style of "The Trustees of the Greenup Union Old School Presbyterian church, of Greenup county," and by said name shall have perpetual succession, and, in their corporate name, have power to buy, take by devise or bequest, or by gift or by deed, any real estate not exceeding two hundred acres, and any personal property, and to hold, convey, and otherwise dispose of the same, with all the powers incident to religious corporations, not inconsistent with the constitution of the United States or of this State; and shall sue, plead and be impleaded, so far as may be necessary to protect the property and rights of said church; and to hold and employ the property so acquired and held by them, and dispose of it, and make contracts about it, solely for the use and purpose of carrying out and promoting the religious interest of said church.

§ 2. In case there should be a vacancy in the trustees, then the session of said church shall be ex-officio trustees, and shall continue in office during life, or their connection with the church, and so long as they reside in the bounds of the church.

§3. This act shall take effect from its passage.

CHAPTER 439.

AN ACT to change the place of voting in the Jeffersonville precinct, in Mont. gomery county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That the place of voting in the Jeffersonville precinct be changed from the house of Henry Green Wade to the house now occupied by J. R. Johns, and lately occupied by Matt. Stephens.

CHAPTER 440.

AN ACT appropriating money toward the completion of the Western Lunatic
Asylum.

Be it enacted by the General Assembly of the Commonwealth of
Kentucky:

That the sum of thirty thousand dollars be paid to the managers of the Western Lunatic Asylum, out of any moneys in the treasury not otherwise appropriated, in quarterly installments, the first of which shall be paid on the 1st day of June next; and which the said managers shall apply toward the completion of a portion of the asylum buildings, for the reception of patients, at as early a day as practicable.

CHAPTER 441.

AN ACT for the benefit of the trustees of Stanford Seminary.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That the trustees of the Stanford Seminary, or their successors, shall have power and authority to purchase any lands in and around the town of Stanford, not exceeding ten acres, which, in their judgment, they may deem necessary for the purposes of said seminary, and shall pay for the same out of any money which may be in their hands belonging to said institution.

§ 2. This act shall take effect from its passage.

CHAPTER 442.

AN ACT to create the office of county treasurer for Grant county.

Be it enacted by the General Assembly of the Commonwealth

of Kentucky:

§1. That there be, and is hereby, created for the county Office created. of Grant the office of county treasurer.

§ 3. That it shall be the duty of the county treasurer for Duty of county said county to collect, receive, and receipt for all moneys due or to become due the said county of Grant from the various collectors of said county, and to hold the same subject to the orders of the county court of said county. He shall have power, and it shall be his duty, to institute suit or suits against all collectors or sheriffs of said county who are, or may become, in arrears with said county for county levies collected, or to be collected, by them. He shall, in the month of September, in each year, settle with the sheriff or collector of said county for the county levy collected during the year, and make a report of such settlement to the next succeeding term of the county court for said county, showing the amount of money collected, how disbursed, and the balance, if any, owing the county. He shall keep a book, to be furnished and paid for as other public books, in which he shall keep a correct account of all moneys received by him for or on account of the county, showing when and on what account received, and how and on what account disbursed by him; said book shall remain in the clerk's office of said county as a part of the records thereof, and shall, at all times, be open to the inspection of any one interested.

4. That it shall not be lawful for any one except the county treasurer to receive or receipt for any money due, or to become due, the county of Grant: Provided, however, That the sheriff or collector may, as heretofore, pay off claims against the county out of the county levy collected by him, and receive a credit therefor in his settlement with the county treasurer.

§ 5. That it shall be the duty of the county judge of said When accounts county, in the month of December in each year, to settle the accounts of the county treasurer, and report such settlement to the next succeeding county court for confirmation, which shall lie over one month for exceptions; and if none be taken at the term last aforesaid, it shall be confirmed, and ordered to record.

services, to be paid out of the county levy, the same fees allowed clerks for similar services.

§ 7. The county treasurer shall receive for his services five per cent. upon all moneys received and disbursed by him; but the county court aforesaid may reduce his allowance to not less than three per cent.

8. The county judge shall receive for each settlement, to be paid out of the county levy, one dollar and fifty cents. § 9. This act shall take effect from and after its passage. Approved March 7, 1862.

CHAPTER 443.

AN ACT incorporating the Kinnikinnick Bridge Company, in Lewis county.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That George W. Bruce, Jabez Truitt, and such other Who may erect persons as may associate themselves for that purpose, be, and they are hereby, authorized to erect a bridge across Kinnikinnick creek, in Lewis county, at or near where the Maysville and Big Sandy railroad crosses said creek; or said Bruce and others may, at the written consent of the board of directors of the Maysville and Big Sandy railroad company, to finish and use the bridge constructed by said company across said creek.

§ 2. When said bridge is completed, said Geo. W. Bruce, Rates of toll. and others, shall be entitled to demand and receive the following tolls for passing said bridge, to-wit: For each man and horse, five cents; for each cart of two wheels, ten cents; for each wagon and two horses or two mules, ten cents; and five cents for each additional horse or mule over two; for each wagon and yoke of oxen, ten cents, and five cents for each additional yoke of oxen; for every riding carriage or buggy and one horse, ten cents, and five cents for each additional horse; for each carriage with two wheels, five cents; for every head of neat cattle, horses, or mules, two cents; for each hog, one cent.

§ 3. Whenever the said Geo. W. Bruce, and others, shall have received from said tolls the amount of the sum actually expended in building said bridge, and ten per cent. thereon, it shall be lawful for the county court of Lewis county to declare the said bridge a free and public bridge, after which said company shall have no right to receive or collect toll on said bridge, but the same shall be considered a county bridge.

§ 4. § 5. It shall be lawful for the persons before named, and When directors other persons who have subscribed to the building of the said bridge, to assemble at Bruce's landing, on the 1st Monday of April, or as soon thereafter as convenient, and elect three directors to superintend the business of said Chairman and company; which directors shall elect their chairman, and such officers as they may think proper, and prescribe rules and regulations, and make contracts for the collection of the toll aforesaid. The election of directors shall take place annually, on the 1st Monday in April, and the directors for the time being shall have power to fill all vacancies between the periods of annual election; and the said directors, in the name and style of "The Kinnikinnick Bridge Company," shall have power to contract and be contracted with, sue and be sued, relative to all the con cerns of the said toll bridge.

§7. As soon as said bridge is completed, the county State road to be court of Lewis shall change the State road so as to cross over said bridge, and shall discontinue the old State road from where it now crosses Kinnikinnick, to Montgomery branch. The court shall appoint viewers to view the route, who shall report the same, when viewed, to the court, and the same proceedings shall be had as is now authorized by law in cases of changing roads or in laying out new roads: Provided, That the court may, with the consent of the persons, fix the amount that shall be paid to each person through whose land said road will pass, which amount, when ascertained, fixed, and agreed on, shall be so much stock in said bridge company; which amount and interest, as well as the costs of construction, shall be paid as aforesaid, before said bridge shall be declared toll free.
