Specification 7th.

JOHNSON COUNTY.

The contestee further shows that at said election for Representative in Congress from the fifth Congressional district, in November, 1882, in the State of Iowa, in the township of Big Grove, in the township of Jefferson, in the township of Monroe, in the township of Madison, in the township of Penn, in the township of Newport, in the township of Grabam, in the township of Iowa City, in the north precinct thereof; in the township of Scott, in the township of Iowa City, in the south precinct thereof; in the township of Lincoln, in the township of Freemont, in the township of Liberty, in the township of East Lucas, in the township of West Lucas, in the township of Union, in the township of Hardin, in the township of Sharon, in the township of Washington, in the township of Cedar, and in the township of Oxford, and in each of them, they and each of them being voting precincts in the county of Johnson, in the said fifth Congressional district of the State of Iowa, fifteen persons in each of said precincts, who were not qualified electors, and who were not qualified nor legal voters within the precinct where they offered their votes, did illegally vote and cast their ballots for the contestant, Benj. T. Frederick, as a candidate for Representative in Congress from said district, and said ballots were, by the judges of election, received and counted and returned for him, the said Benj. T. Frederick, in each of said precincts.

And in each of said precincts two qualified electors therein did vote and cast their ballots for this contestee as a candidate for said office of Representative, which ballots were not counted nor returned for him, said contestee.

Specification 8th.

BENTON COUNTY.

Your contestee further shows and charges the fact to be, that at the November election for the year 1882, at the township of Vinton, in the precinct of Vinton, in Benton County, State of Iowa, six persons, not voters nor electors nor entitled to vote at said election, did vote and cast their ballots for Benjamin T. Frederick for Representative in Congress from the fifth Congressional district of said State, and that said ballots were by the judges of said election precinct deposited in the ballot-box and were by said judges illegally counted and returned for said Benjamin T. Frederick.

Specification 9th.

BENTON COUNTY, FREEMONT AND IOWA TOWNSHIPS.

Your contestee further shows and charges the fact to be, that at the November election for the year 1882, in the township of Freemont, a voting precinct in Benton County, in the fifth Congressional district of the State of Iowa, and in the township of Iowa, a voting precinct in said county, district, and State, and in each of said precincts, eight persons, not qualified voters or electors, and not entitled to vote in either of said precincts did illegally vote and cast their ballots for Benjamin T. Frederick for Representative in Congress from the district aforesaid, and said ballots were by the judges of the election in each of the said precincts received and deposited in the ballot-boxes, and said illegal votes were by the judges of said election counted and returned for said Benjamin T. Frederick.

Specification 10th.

BENTON COUNTY.

Your contestee further shows and charges the fact to be, that at the November election for the year 1882, the following named townships, and each of them, were voting precincts in the county of Benton, in the fifth Congressional district of the State of Iowa, to wit, Florence Township, St. Clair Township, Leroy Township, Kane Township, Union Township, Eldorado Townshi", Shellsburg Township, Canton Township, Eden Township, Big Grove Township, Homer Township, Monroe Township, Jackson Township, Taylor Township, Benton Township, Polk Township, Harrison Township, Cedar Township, and Bruce Township; that at said precincts, and each of them, at said November election, five persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast their ballots for Benj. T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were received by the judges of election at each of said precincts and by them deposited in the ballot-box and counted and returned for said Benjamin T. Frederick.

Specification 11th.

BENTON COUNTY.

Your contestee further charges and shows the fact to be, that at the November elec tion for the year 1882, at the township of Vinton, at the township of Polk, at the township of Leroy, at the township of Union, at the township of Iowa, and at each of them, they and each of them being voting precincts in the county of Benton, in the fifth Congressional district of the State of Iowa, the contestant, Benjamin T. Frederick, did, prior to said November election, deposit at such precincts and each of them, with persons whose names are unknown to your contestee, large sums of money to be corruptly used to procure votes for the said Frederick for Representative in Congress as aforesaid, and that said money so deposited was used by the said persons, on said day of election, and prior thereto, with the knowledge and procurement of the said Benjamin T. Frederick to procure votes for him as aforesaid, and that by the use of the said corruption fund so furnished by the said Frederick as aforesaid, ten persons were procured in each of said precincts to vote for said Frederick for Representative in Congress as aforesaid, who would not have voted for him but for the corrupt use of the said fund as aforesaid.

Specification 12th.

BENTON COUNTY.

Your contestee further shows and charges the fact to be, that at the November election for the year 1882, in the township of Polk, a voting precinct in the county of Benton, in the fifth Congressional district of the State of Iowa, after the polls were closed at said precinct and before the ballots were counted, the judges of election wrongfully, illegally, and unlawfully excluded the public and compared the lists and counted the ballots in a room with locked doors, from which the public was unlawfully excluded as aforesaid, and did unlawfully return the private count to the county board of canvassers, who unlawfully counted and returned the same to the State board; and in said counting sixty-two more votes than the said Benjamin T. Frederick was entitled to were counted and returned for him as a Representative in Congress from the precinct and district aforesaid.

Specification 13th.

IOWA COUNTY.

Your contestee further shows and charges the fact to be, that at the November election for the year 1882, for the election of Representative in Congress, the following named townships, and each of them, were voting precincts in the county of Iowa, in the fifth Congressional district of the State of Iowa, to wit, Cono Township, Washington Township, Lennox Township, Honey Creek Township, Sumner Township, Hartford Township, Lincoln Township, Pilot Township, Troy Township, York Township, Dayton Township, English Township, Fillmore Township, Green Towns ip, Iowa Township, Homestead Township, and Amana Township; that at said precincts, and each of them, at said November election, five persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast their ballots for Benjamin T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were received by the judges of election at each. of said precincts, and by them counted and returned for said Benjamin T. Frederick.

Specification 14th.

TAMA COUNTY.

Your contestee further shows and charges the fact to be, that at the November elec-. tion for the year 1882, for the election of Representative in Congress the followingnamed townships, and each of them, were voting precincts in the county of Tama, in the fifth Congressional district of the State of Iowa, to wit, Tama Township, Carroll Township, Highland Township, Otter Creek Township, York Township, Indian Village Township, and Spring Creek Township; that at said precincts and each of them, at said November election, twelve persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast. their ballots for Benjamin T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were by the judges of said election in each of said precincts, received and counted and returned for the said Benj. T. Frederick as such candidate.

Specification 15th.

TAMA COUNTY,

Your contestee further shows and charges the facts to be, that at the November election for the year 1882, for the election of Representatives in Congress, the followingnamed townships, and each of them, were voting precincts in the county of Tama, in the fifth Congressional district of the State of Iowa, to wit, Toledo Township, Richland Township, Grant Township, Crystal Township, Columbia Township, Lincoln Township, Buckingham Township, Perry Township, Salt Creek Township, Clark Township, Oneida Township, Carlton Township, and Howard Township.

That at said precincts and at each of them, at said November election, five persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast their ballots for Benj. T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were at each of said precincts received and counted and returned for the said contestant.

Specification 16th.

TAMA COUNTY.

Your contestee further shows and charges the facts to be, that at the November election for Representatives in Congress in the year 1882 the following-named townships, and each of them, were voting precincts in the county of Tama, in the fifth Congressional district of the State of Iowa, to wit, Tama Township and Carroll Township; that at said precinct of Tama Township, at said election, this contestee received as a candidate for Representative in Congress from said district one hundred and eighty-six votes, which were cast by qualified electors in that precinct; and at the precinct of Carroll this contestee received as a candidate for Representative in Congress from said district forty-nine votes, which were cast by qualified electors in that precinct; which ballots were received by the judges of the respective precincts, and which were not returned for this contestee, but which should now be counted for him.

Specification 17th.

LINN COUNTY.

Your contestee further shows and charges the facts to be, that at the November election for the year 1882 for the election of Representatives in Congress the followingnamed townships, and each of them, were voting precincts in the county of Linn, in the fifth Congressional district of the State of Iowa, to wit, Franklin Township, College Township, Fairfax Township, Clinton Township, Bertram Township, Linn Township, Brown Township, Monroe Township, Washington Township, Otter Creek Township, Maine Township, Buffalo Township, Spring Grove Township, and Grant Township.

That at said precincts, and at each of them, at said election, thirty persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast their ballots for Benj. T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were at each of said precincts received and counted and returned by the judges of said respective election precincts for said contestant.

Specification 18th.

LINN COUNTY.

Your contestee further shows and charges the facts to be, that at the November election for the year 1882 for the election of Representatives in Congress the followingnamed precincts, and each of them, were voting precincts in the county of Linn, in the fifth Congressional district of the State of Iowa, to wit, the first ward in the city of Cedar Rapids, in the township of Rapids, in said county and Congressional district; the second ward in the city of Cedar Rapids, in the township of Rapids, in said county and Congressional district; the third ward in the city of Cedar Rapids, in the township of Rapids, in said county and Congressional district; the fourth ward in the city of Cedar Rapids, in the township of Rapids, in said county and Congressional district; the fifth ward, and the sixth ward, and the seventh ward, and the eighth ward, in the city of Cedar Rapids, in the township of Rapids, in said county and Congressional district.

That at said precincts, and at each of them, at said election, forty persons who were not entitled to vote at the precinct where they voted, and who were not qualified electors, voted and cast their ballots for Benj. T. Frederick for Representative in Congress from said district as aforesaid, which said ballots were at each of said precincts received and counted and returned by the judges of the said respective election precincts for the said contestant, Benj. T. Frederick.

I, J. H. Bradley, being first duly sworn, do depose and affirm and state that on the first day of February, A. D. 1883, in said county and State at the city of Marshalltown, I served the foregoing answer of the contestee, by offering to read the same to J. L. Carney, esq., one of the firm of Brown and Carney, the contestant's solicitors, which reading he then and there waived, and by giving to him a true copy of said answer. Done at the office and place of business of Brown and Carney, said contestant's, solicitors, the said contestant, Benjamin T. Frederick, not being found at his usual place of business nor at his residence.

And I also served the same by giving a copy thereof to Mrs. Wealthy T. Frederick, the wife of the contestant, Benjamin T. Frederick, and a member of his family over 21 years of age, at the residence of said Benjamin T. Frederick, in said city of Marshalltown, Iowa, both the said contestant, Benjamin T. For the office of Representative in Congress there were three thousand nine hundred and ninety-nine (3,999) votes cast, of which James Wilson received two thousand and seventeen (2,017) votes; B. T. Frederick received seventeen hundred and sixtyeight (1,768) votes; scattering received one (1) vote: David Platner received two hundred and thirteen (213) votes.

In testimony whereof, we have hereunto set our hands and caused this to be attested by the clerk of the board of supervisors, and the seal of said county.
