On motion of Senator Tapp, an emergency was declared, the rules were suspended, and Senate bill No. 690 was placed on second reading.

Senate bill No. 690 was read a second time and referred to the committee of the whole.

Senator Carpenter moved to reconsider the vote by which House bill No. 260 was passed, this morning.

The motion prevailed.

Senator Carpenter moved that House bill No. 260 be taken up at this time.

Senator Carpenter moved to amend section 1, House bill No. 260, line 7, by inserting the following: "In counties of 20,000 inhabitants and less."

The motion prevailed, and amendment adopted.

Also, in line 14, House bill No. 260, following the word "ballots," section 1, insert the following: "In counties over 20,000 inhabitants, the price paid for such ballots shall be seven dollars per thousand or fraction thereof in presidential years, if there be not more than four tickets upon such ballots, and one dollar per thousand or fraction thereof for each additional ticket upon such ballots; and the price shall be five dollars per thousand or fraction thereof in all other years, if there be not more than four tickets upon such ballots, and one dollar per thousand or fraction thereof for each additional ticket upon such ballots."

The motion prevailed, and amendment adopted.

Senator Leidy introduced Senate concurrent resolution No. 37, as follows:

WHEREAS, It has been decided by the United States government to name a battle-ship for the state of Kansas; and

WHEREAS, This state has forever prohibited the manufacture and sale of intoxicating liquor; and

WHEREAS, In the near future this battle-ship will be christened according to a time-honored custom: therefore, be it

Resolved, the House of Representatives concurring therein, First, that no wine, champagne or other intoxicating liquor shall be used on that occasion; second, that said battle-ship shall be christened with the mingled waters of our own sun kissed rivers of Kansas, the Arkansas and the Kaw.

A roll call was demanded, with the following result: Yeas 15, nays 20.

Senators voting in the affirmative were: Branine, Buschow, Codding, Crum, Findlay, Fitzpatrick, Householder, Hurrel, King, Leidy, Miller, Morehouse, Porter, Simons, and Tapp.

Senators voting in the negative were: Allen, Carpenter, Chaney, Conrad, Fulton, Gabriel, Henley, Kennedy, McMillan, Morrow, Noftzger, Pestana, Peterson, Smith, Sponable, Stewart, Vincent, Ward, and Wright.

Senators absent or not voting were: Caldwell, Cubbison, Fullington, McKnight, White, and Wulfekuhler.

A constitutional majority having voted against the resolution, the resolution was lost.

PRESIDENT: I am directed by the House to inform the Senate that the House has passed Senate bill No. 200, An act to promote the attendance of pupils in schools, to prevent truancy, to provide for the appointment of officers, to define the rights and duties and compensation of such officers, to prescribe the penalties for violation of this act, and to repeal chapter 23 of the Session Laws of 1874, being paragraphs 6420, 6421, 6422 and 6423 of the General Statutes of Kansas, 1901. MR. PRESIDENT: I am directed by the House to inform the Senate that the House has amended, and passed as amended, Senate bill No. 563, An act making appropriation for the state printer for the fiscal years ending June 30, 1904, and June 30, 1905, and regulating the expenditure thereof.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has amended, and passed as amended, Senate bill No. 567, An act relating to service of summons upon foreign corporations and joint-stock companies.

Also, passed House bill No. 980, An act authorizing and empowering the board of education of the city of Scammon, Cherokee county, Kansas, a city of the second class, to levy, in the years 1903 and 1904, a tax for school purposes not exceeding twenty mills on the dollar.

Also, has concurred in Senate amendments to House bill No. 137, An act to amend section 6, chapter 68, of the General Statutes of Kansas of 1901, relating to the release of mortgages, and repealing said original section.

Also, passed Senate bill No. 656, An act to amend section 1 of chapter 223, Laws of 1901, entitled "An act for the protection of

birds, providing at what seasons birds may be shot, to prohibit the sale and shipment of birds, prescribing a punishment for the violation of this act, and to repeal chapter 223 of the Laws of 1901, and chapter 45 of the General Statutes of 1901, and all acts in conflict herewith."

PRESIDENT: Your Committee on Roads and Highways, to whom was referred House bill No. 540, An act providing for the improvement of county roads in Johnson county, Kansas, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be amended as follows: In section 1, line 5, strike out "any county in this state" and insert "Johnson county"; in section 10, line 5, strike out respecttive counties" and insert "county"; and that it be passed as amended. Senator Branine, chairman of the Committee on Military Affairs and Claims, offered the following report:

MR. PRESIDENT: Your Committee on Military Affairs and Claims, to whom was referred Senate bill No. 267, An act making appropriations to pay the officers and men of Capt. William H. Hiner's company of New Lancaster rifles, and Capt. George H. Hume's company of independent cavalry, for service and use of horses on the border of Kansas during the years of 1861, 1862, and 1863, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be not passed.

PRESIDENT: Your Committee on Ways and Means, to whom was referred House bill No. 734, An act making appropriation for the current expenses of the Osawatomie State Hospital for the fiscal years ending June 30, 1904, and June 30, 1905, and for the purchase of additional lands, for the erection of a stand-pipe, for the building of an ice plant, and for the macadamizing of a road, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be amended by striking out, in section 1, "superintendent, 1904, $2000, 1905, $2000," and insert "superintendent, 1904, $1800, 1905, $1800," and the bill be passed as amended.

Also, House bill No. 467, An act providing a sinking-fund for the payment of the bonds of the state at maturity, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 778, An act making an appropriation to sundry persons herein named for the costs incurred in the case of State of Kansas v. Frank Grimes, state treasurer, et al., in the district court of Osage county, Kansas, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 408, An act providing for refunding certain bonds issued by the state under section 3 of chapter 242, Session Laws of 1897, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 662, An act making appropriations for the

current expenses of the School for the Deaf, at Olathe, for the fiscal years ending June June 30, 1904, and June 30, 1905, and for the erection of a school building and gymnasium, and for heating and equipping the same, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 660, An act making appropriation for the current expenses and repairs on main building of the Industrial School for Girls, for the fiscal years ending June 30, 1904, and June 30, 1905, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, House bill No. 362, An act making appropriations to the State Agricultural College for the erection and equipment of certain buildings, construction of water plant, for the purchase of lands, for maintenance, current expenses, and repairs, for the fiscal years ending June 30, 1903, June 30, 1904, June 30, 1905, and to provide for fees to be charged students at said Agricultural College, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Senator Sponable moved that the rules be suspended, and that House bill No. 540 be placed on third reading. The motion prevailed.

House bill No. 540, An act providing for the improvement of county roads in Johnson county, Kansas, was read the third time.

Senator Sponable moved to amend House bill No. 540, in section 1, line 5, by striking out the words "any county in this state" and inserting "Johnson county," and also in section 10, line 5, by striking out the words "respective counties" and inserting the word "county."

The amendment was adopted.
