SEC. 2. Every foreign corporation having a permit to do business in the state shall, in lieu of the statements or reports now required by law, during the month of February in each year, beginning with the year 1904, file with the secretary of state a written statement of the condition of such corporation at the close of business on the day of the last regular annual statement made by such corporation for its own use, and within 125 days next preceding the filing of such statement with the secretary of state. If no such regular annual statement for the use of such corporation shall have been made within such 125 days, then the statement filed with the secretary of state shall show the condition of the corporation at the close of business on the 31st day of December next preceding. Such statement shall show the full corporate name of such corporation; the location of its principal office or place of business without this state; the location of its principal office or place of business within this state, if any it has; the names and addresses of its officers and directors; the amount of its authorized capital stock and the amount of each share; the amount of its capital subscribed; and the amount and general nature of its resources and liabilities, in a form to be prescribed by the Charter Board. Such statement shall be subscribed and sworn to by the president or general manager and by the secretary of such corporation, and shall be made upon a blank furnished by the secretary of state.

SEC. 3. This act shall take effect and be in force from and after its publication in the statute-book.

Senator Kennedy moved that the substitute just read be printed and placed on the Calendar. .

Senator Noftzger moved, as a substitute for the motion of Senator Kennedy, that the bill be made a special order at two o'clock P. M.

Also, passed House bill No. 758, An act amending section 2 of chapter 55 of the Session Laws of 1895, being "An act authorizing cities of the second class to purchase, procure, provide, contract for and construct water-works, electric-light and gas plants, and to issue bonds for the indebtedness created thereby," and repealing the original section so amended.

Also, has concurred in Senate amendments to House bill No. 512, An act to amend section 415 of the General Statutes of 1901, being section 9 of chapter 47 of the Session Laws of 1897, relating to the management and control of state banks, and repealing the original sections numbered 415 and 9, respectively.

Also, concurred in Senate amendmend to House bill No. 715, An act to amend an act entitled "An act relating to trust companies, defining their powers and duties, providing for their management, control, and supervision, and providing penalties for violation of the

provisions of this act," approved March 2, 1901, and repealing section 2 of chapter 407 of the Laws of Kansas of 1901.

Also, passed Senate bill No. 681, An act relating to cities having a population of more than 50,000 inhabitants, and empowering such cities to contract and fix rates for and obtain water, heat, light and power for public and private use, and repealing sections 1, 2, 3, 4, 5, 6 and 7 of chapter 82 of the Laws of 1897, in so far as said sections relate to such cities.

COMMITTEE OF THE WHOLE.

Senator Carpenter moved that the Senate go into committee of the whole for the consideration of bills on the Calendar under the head of "General Orders." A vote being had, the motion prevailed.

The Senate went into committee of the whole, with Senator McKnight in the chair.

After some time spent therein the committee rose, and through the chairman submitted the following report:

MR. PRESIDENT: The committee of the whole Senate have had under consideration bills on the Calendar under the head of "General Orders," and I am directed to report as follows:

Recommend that Senate bill No. 308, An act to establish a juvenile court and regulate the treatment and control of delinquent children, be indefinitely postponed.

Also, Senate bill No. 310, An act to amend section 1704 of the General Statutes of 1901, in relation to the deposit of county funds in certain counties, be indefinitely postponed.

Also, Senate bill No. 495, An act prohibiting the solicitation of life-insurance in this state and prescribing rules therefor, and providing penalties for the violation thereof, be passed as amended.

Also, Senate bill No. 496, An act in relation to life insurance, be passed.

Also, Senate bill No. 573, An act to amend section 2 of chapter 165 of the Session Laws of 1887, the same being section 2401 of the Compiled Statutes of Kansas for the year 1889, be passed as amended, subject to amendment and debate.

Also, House bill No. 374, An act to amend sections 6424, 6425, and 6426, General Statutes of Kansas of 1901, be placed on third reading, subject to amendment and debate.

Also, House bill No. 550, An act providing for the suppression of mob violence, defining the crime of lynching, providing a penalty therefor, be passed as amended.
