MESSAGES FROM THE HOUSE.

The sergeant-at-arms announced a message from the House by its chief clerk. The message was read, as follows :

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has adopted House concurrent resolution No. 4, Relating to amendment of interstate-commerce law.

The resolution is herewith transmitted.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has adopted Senate concurrent resolution No. 7, Relating to the International Harvester Company of North America. Also, Senate concurrent resolution No. 6, relating to coal famine, with amendments.

PRESENTATION OF BILLS.

The Ways and Means Committee introduced Senate bill No. 105, An act making appropriation for legislative pur

poses.

On motion of Senator Chaney, the rules were suspended, an emergency declared and the bill read a second time. A further emergency was declared and bill placed on third reading.

The roll was called.

Senators voting in favor of the passage of the bill were: Senators Branine, Buschow, Caldwell, Carpenter, Chaney, Codding, Conrad, Crum, Findlay, Fitzpatrick, Gabriel, Henley, Householder, Hurrel, Kennedy, King, Leidy, McKnight, McMillan, Miller, Morehouse, Morrow, Noftzger, Pestana, Peterson, Porter, Simons, Smith, Sponable, Stewart, Tapp, Vincent, White, Wright, Wulfekuhler.

Senators absent or not voting were: Allen, Cubbison, Fullington, Fulton, Ward.

A constitutional majority having voted in favor of the passage of the bill, the bill was passed, and the title agreed to.

Senator Pestana introduced Senate bill No. 106, An act declaring the person therein named the adopted daughter and heir of A. D. Gilkeson.

The hour for special order, set at eleven o'clock, having arrived, House bill No. 2 was called up.

The Judiciary Committee reported that a substitute bill had been framed by the Senate Judiciary Committee, and recommended that it be substituted for House bill No. 2, as follows:

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred House bill No. 2, An act in relation to the Kansas State Penitentiary, have had the same under consideration, and report the following bill as a substitute for House bill No. 2, and recommend that the same be adopted and passed.

On motion of Senator Smith, the committee bill was substituted for House bill No. 2.

On motion of Senator Smith, the rules were suspended, an emergency declared, and the bill placed on third reading, subject to amendment and debate.

Substitute for House bill No. 2, An act in relation to the Kansas State Penitentiary, approving the contract heretofole made for the custody therein of convicts from Oklahoma territory and providing for a new contract with reference thereto, and defining the duties of the warden of the State Penitentiary.

The roll was called.

By Senator Porter: Senate bill No. 107, An act to empower the mayor and city council of the city of McCune, Crawford county, to transfer three hundred sixteen dollars and fifty cents of the money now in the city treasury belonging to the water-works fund to the sinking-fund.

By Senator Hurrel: Senate bill No. 108, An act to amend section 105, article 3, chapter 31, General Statutes 1868, reprinted as section 2051 of the General Statutes of 1889.

By Senator Kennedy: Senate bill No. 109, An act to vacate a certain alley in the city of Le Roy, Coffey county, Kansas.

Also, Senate bill No. 110, An act to revive the certificate of pharmacy of J. M. Allison.

By Senator Caldwell: Senate bill No. 111, An act to exempt from taxation the homestead of Union soldiers and sailors and the widows of Union soldiers and sailors.

Also, Senate bill No. 112, An act providing protection to mechanics, laborers and other persons in the construction and repair of railway equipment and providing punishment for violation thereof.

Also, Senate bill No. 113, An act to prohibit the desecration of the Sabbath day, commonly called Sunday.

By Senator Hurrel: Senate bill No. 114, An act to provide for the assessment, levy and collection of taxes.

By Senator Codding: Senate bill No. 115, An act relating to county board of examiners, and to provide for professional certificates to be issued by county board of examiners, and repealing chapter 175, Laws of 1885.

Also (by request), Senate bill No. 116, An act to provide for fire-escapes, fire protection, and for the regulation of the sanitary conditions of hotels, restaurants, and boarding-houses, and for punishment for the violation of the provisions of this act.

Also, Senate bill No. 117, An act to regulate and define the practice of optometry, to punish the violators thereof, to create a board of examiners, provide for their appointment, compensation, and for examination of others, and prevent incompetent or unauthorized persons from engaging in the practice thereof.

By Senator Morehouse: Senate bill No. 122, An act to amend section 12, article 3, of chapter 122, of the Session Laws of 1876, entitled "An act for the regulation and support of common schools," and to repeal original section 12, article 3, of chapter 122, of the Session Laws of 1876.

By Senator Tapp: Senate bill No. 123, An act to amend section 1, chapter 134, Session Laws of 1901, providing for the appointment of stenographers by county attorneys, fixing the salary and providing for 'the payment thereof, and prescribing their duties.

Also, Senate bill No. 124, For relief of county officers of Sedgwick county, Kansas.

Also, Senate bill No. 125, An act relating to the salary of the county clerk of Sedgwick county, in the state of Kansas, and providing for clerk hire in the offices of the county clerk and county treasurer in said county, and to repeal sections 2 and 4 of chapter 141 of the Session Laws of 1899, in so far only as is necessary in order to give effect to this act.

By Senator Smith: Senate bill No. 126, An act to amend section 1821 of the General Statutes of 1901, relating to appeals made from surveys made by the county surveyor.

By Ways and Means Committee: Senate bill No. 127, An act making an appropriation for postage, express and freight for the Thirteenth Biennial Report of the State. Board of Agriculture.

By Senator Gabriel (by request): Senate bill No. 128, An act to regulate the advertising and sale of proprietary or patent medicines or nostrums within the state of Kan

sas and to provide a revenue to the state for the sale of such articles.

By Senator Wulfekuhler: Senate bill No. 129, An act making appropriation to aid in the support and maintenances of district school No. 75, located at Lansing, Kan., for the fiscal years ending June 30, 1904, and June 30, 1905.

Also, Senate bill No. 130, An act authorizing private corporations to acquire, hold, improve, lease, rent, sell or exchange real estate in cities of the first class, and to act as agents for the purchase, lease, rent, sale or exchange of the properties of other corporations and individuals.

Also, Senate bill No. 131, An act to require a brand upon all goods, wares, merchandise or other articles or things made for sale by convict labor in any penitentiary, industrial reformatory, school or other establishment in which convict labor is employed.

By Senator Allen: Senate bill No. 132, An act regulating the appointment of an attorney in divorce cases.

Also, Senate bill No. 133, An act in relation to quarantine yards, and defining the word "quarantine."

Also, Senate bill No. 134, An act to amend section 11 of an act entitled "An act providing for the health and safety of persons employed in coal-mines," approved May 28, 1879, in force July 1, 1879, as amended by an act approved June 18, 1883, and an act approved June 30, 1885, and to repeal section 2 of an act entitled "An act to require inspectors of mines to furnish information to the state geologist, and to provide for paying the expenses of the same," approved June 18, 1891.
