Senate bill No. 431, An act to enable Kingman township, in Kingman county, Kansas, to erect a township hall, furnishing and locating the same, and conferring power of township board to issue bonds to pay for the same, and providing for an election upon petition to vote on said proposition.

MR. PRESIDENT: Your Committee on Fees, Salaries, and Mileage, to whom was referred Senate bill No. 266, An act relating to the fees and salary of the probate judge of Sedgwick county, in the state of Kansas, and to repeal section 14 of chapter 141 of the Session Laws of 1899 and all acts and parts of acts inconsistent herewith, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

MR. PRESIDENT: Your Committee on Ways and Means, to whom was referred Senate bill No. 320, An act legalizing the Kansas State Poultry Association, to define certain duties of said association, to make annual appropriation therefor, and fixing a penalty for the misappropriation of any of the money hereby granted, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be printed, placed upon the Calendar, and referred to the committee of the whole.

Also, Senate bill No. 168, An act making appropriations for the State Geological Survey of Kansas, and providing for the publication of the same, and instruct me to report the bill back to the Senate with the recommendation that it be not passed.

Also, Senate bill No. 157, An act for the industrial home for the blind of Kansas, and instruct me to report the bill back to the Senate with the recommendation that it be not passed.

Also, Senate bill No. 181, An act for the appropriation of certain money for the building and equipping of a gymnasium for the University of Kansas, and instruct me to report the bill back to the Senate with the recommendation that it be printed, placed upon the Calendar, and referred to the committee of the whole.

Also, House bill No. 469, An act making appropriation for legislative purposes, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Senator Wulfekuhler, acting chairman of the Committee on Cities of the First Class, offered the following reports:

MR. PRESIDENT: Your Committee on Cities of the First Class, to whom was referred Senate bill No. 158, An act relating to public parks, parkways and boulevards for cities of the first class having a population of 50,000 or more, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 86, An act to amend section 1 of chapter 102 of the Session Laws of 1901, entitled "An act providing for the organization, regulation and dissolution of corporations for the establishment and maintenances of cemeteries in or adjacent to cities of the first class having a population of over 50,000 inhabitants," and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 155, An act relating to the building and furnishing of a court-house at Kansas City, and instruct me to report the bill back to the Senate with the recommendation that it be not passed. LOUIS H. WULFEKUHLER, Acting Chairman.

On motion of Senator Chaney, emergency was declared, the rules were suspended, and House bill No. 469, An act making appropriation for legislative purposes, was placed on third reading at this time, and the question being, Shall the bill pass? the roll was called, with the following result: Yeas 28, nays 0; absent or not voting, 12.

Senators voting in favor of the passage of the bill were: Branine, Buschow, Carpenter, Chaney, Conrad, Crum, Findlay, Fulton, Gabriel, Henley, Householder, Hurrel, Ken

Senators absent or not voting were: Allen, Caldwell, Codding, Cubbison, Fitzpatrick, Fullington, Leidy, Miller, Noftzger, Porter, Smith, Ward.

A constitutional majority having voted in favor of the passage of the bill, the bill passed, and the title was agreed to. Senator White asked unanimous consent of the Senate to withdraw Senate bill No. 265.

Consent was granted.

Senator Noftzger moved that the committee provided for by Senate resolutton No. 38 be increased from three to five members.

The motion prevailed.

MESSAGES FROM THE HOUSE.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has passed Senate bill No. 43, An act to repeal chapter 137, Laws of Kansas, 1901, entitled "An act concerning the election of a county printer in Barber county, Kansas, prescribing his duties and compensation, and repealing all acts and parts of acts in conflict with this act."

Also, passed House bill No. 438, An act fixing the fees and salary of the sheriff of Shawnee county, in the state of Kansas, and repealing all acts and parts of acts in conflict herewith.

Also, passed House bill No. 466, An act making appropriation for the payment of interest on state bonds for the fiscal years ending June 30, 1904, and June 30, 1905.

Also, passed House bill No. 467, An act providing a sinking-fund for the payment of the bonds of the state at maturity.

Also, passed House bill No. 468, An act providing for refunding certain bonds issued by the state under section 3 of chapter 212, Session Laws of 1897.

Also, passed House bill No. 470, An act to amend section 1 of chapter 181, Session Laws of 1891, entitled "An act to establish the salaries of state officers, their assistants and clerks, judges, officers and employees of the Legislature," the same being paragraph No. 6076 of the General Statutes of Kansas, 1901..

Also, passed House bill No. 342, An act to amend section 15, chapter 31, General Statutes of 1868, being paragraph 2000, General Statutes of 1901, relating to the crime of manslaughter.

Also, passed House bill No. 318, An act authorizing Elizabeth Parks to sell and convey the within described land.

Senator Smith moved that the Senate go into committee of the whole for the consideration of bills on the Calendar under the head of "General Orders." A vote being had, the motion prevailed.

The Senate went into committee of the whole, with Senator Pestana in the chair.

After some time spent therein the committee rose, and through the chairman submitted the following report:

Recommend that House joint resolution No. 4, In relation to Oklahoma prisoners, be passed.

Also, substitute for Senate bill No. 150, An act in relation to school-land sales and extensions of maturity of school-land certificates, amending section 239, article 14, chapter 93, of the General Statutes of 1901, be passed.

Also, Senate bill No. 195, An act authorizing the levy of road tax, providing for the appointment of township road overseers and prescribing their duties, and providing for the removal of the same for cause, authorizing the collection of certain road tax by suit, and repealing sections 23, 24, 25, 26 and 27 of chapter 154 of the General Statutes of 1897, the committee report progress and ask leave to sit again.
