Senator Conrad, chairman of the Committee on Agriculture, offered the following reports:

MR. PRESIDENT: Your Committee on Agriculture, to whom was referred Senate bill No. 327, An act to amend section 12 of chapter 101, Session Laws of 1901, being paragraph 7455 of the General Statutes of 1901, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 177, An act concerning the weighing of grain at public elevators and warehouses and providing for track scales at such elevators and warehouses and weighing grain thereon, and instruct me to report the bill back to the Senate with the recommendation that Senate bill No. 391 be substituted for Senate bill No. 177, and that the same be passed.

THIRD READING OF BILLS.

Senate concurrent resolution No. 18, Relating to the submission of a proposition to amend the constitution of the state of Kansas, was read the third time, and the question being, Shall the resolution pass? the roll was called, with the following result: Yeas 31, nays 2; absent or not voting, 7.

Senators voting in favor of the passage of the resolution were: Branine, Buschow, Caldwell, Carpenter, Chaney, Codding, Conrad, Crum, Findlay, Fitzpatrick, Gabriel, Henley, Householder, Hurrel, Kennedy, King, Leidy, McKnight, Morehouse, Morrow, Noftzger, Pestana, Peterson, Simons, Smith, Stewart, Tapp, Vincent, White, Wright, Wulfekuhler.

Senators voting in the negative were: Fulton, McMillan. Senators absent or not voting were: Allen, Cubbison, Fullington, Miller, Porter, Sponable, Ward.

A constitutional majority having voted in favor of the passage of the bill, the bill passed, and the title was agreed to.

Senate bill No. 204, An act to cover parole of convicted persons, was read the third time, and the question being, Shall the bill pass? the roll was called, with the following result Yeas 18, nays 19; absent or not voting, 3.

Senators voting in favor of the passage of the bill were: Senators Buschow, Carpenter, Findlay, Householder, Hurrel, Kennedy, Leidy, Miller, Noftzger, Pestana, Porter, Simons, Smith, Stewart, Tapp, Ward, White, and Wright.

Senators voting in the negative were: Senators Allen, Branine, Caldwell, Chaney, Codding, Conrad, Crum, Fitzpatrick, Fulton, Gabriel, Henley, King, McKnight, McMillan, Morehouse, Morrow, Peterson, Vincent, and Wulfekuhler.

Senators absent or not voting were: Senators Cubbison, Fullington, and Sponable.

A constitutional majority not having voted in favor of the passage of the bill, the bill was lost.

Senator Allen moved that Senate bill No. 204 be reconsidered.

Senator Chaney moved that we do now adjourn.

The motion was lost.

On demand of Senators Smith, Allen and Noftzger for the yeas and nays on the motion to reconsider Senate bill No. 204, the roll was called, with the following result: Yeas 20, nays 16; absent or not voting, 4.

Senators voting in favor of the reconsideration of the bill were: Allen, Buschow, Carpenter, Findlay, Gabriel, Householder, Hurrel, Kennedy, Leidy, McMillan, Miller, Noftzger, Pestana, Porter, Simons, Smith, Stewart, Tapp, Ward, and Wright.

A majority having voted in favor of the reconsideration of Senate bill No. 402, the motion to reconsider prevailed On motion of Senator Allen, the Senate adjourned.

MESSAGES FROM THE GOVERNOR.

EXECUTIVE DEPARTMENT, February 6, 1903.

I have this day approved Senate bill No. 41, An act concerning the venue of certain actions, and to amend sections 50 and 55 of chapter 80, Laws of 1868, of "An act to establish a code of civil procedure," approved February 25, 1868, and to repeal section 63 of chapter 23, General Statutes of the state of Kansas, 1868.

Also, Senate bill No. 51, An act authorizing the board of county commissioners of Barton county, Kansas, to build and construct a county jail and sheriff's residence at the city of Great Bend, in said county, and to provide for the payment of the cost thereof. W. J. BAILEY, Governor.

INTRODUCTION OF BILLS.

By Senator Buschow (by request): Senate bill No. 432, An act in relation to the remittance of state funds in the hands of the county treasurer to the state treasurer, prescribing the duties of officers in regard thereto, and repealing all acts and parts of acts in conflict with this act.

By Senator Noftzger: Senate bill No. 433. An act to prevent adulteration of candies and to provide penalties for violations thereof.

Also, Senate bill No. 434, An act to prohibit the operation of what is known as "slot machines" for gambling purposes, and to provide a penalty and punishment there

for.

By Ways and Means Committee: Senate bill No. 435, An act making appropriation for the State Soldiers' Home and Mother Bickerdyke Home for the fiscal years ending June 30, 1903, and June 30, 1904, and June 30, 1905, and placing restrictions upon certain officers of said board.

On motion of Senator Chaney, emergency was declared, the rules suspended, and Senate bill No. 435 was placed on second reading.

Senate bill No. 435 was read and referred to committee of the whole.

Also, Senate bill No. 436, An act appropriating money to the University of Kansas for the maintenance and support of said University for the fiscal years ending June 30, 1904, and June 30, 1905, for construction of improvements and repairs, and for a law building and equipment, complete.

On motion of Senator Chaney, emergency was declared, the rules suspended, and Senate bill No. 436 was placed on second reading.

Senate bill No. 436 was read and referred to committee of the whole.

By Senator McKnight: Senate bill No. 437, An act to provide for making repairs upon the building in which the first territorial Legislature of Kansas met on July 2, 1855, located at the old town of Pawnee (now a part of the Fort Riley military reservation, in Geary county, Kansas), and making appropriation therefor.

By Senator Allen: Senate bill No. 438, An act empowering the county commissioners of Wyandottee county, Kansas, to improve and maintain certain public highways in said county.

Also, Senate bill No. 439, An act providing for the creation of a fire-marshal department for the state of Kansas,

and appointment of a fire marshal and his assistants and prescribing their duties, and regulating the establishment and management of the office and appropriating funds for its support, and providing penalties for the violation of the provisions of this act.

By Senator Tapp: Senate bill No. 440, An act providing for the application of the excess of fees of the register of deeds of Sedgwick county, Kansas.

On motion of Senator White, the rules were suspended, an emergency declared, and Senate bill 440 was placed on second reading.

Senate bill No. 440 was read and referred to Committee on Fees, Salaries, and Mileage.
