pupils in schools, to prevent truancy, to provide for the appointment of truant officers, to define the rights and duties and compensation of officers, to prescribe the penalties for violation of this act, and to repeal chapter 23 of the Session Laws of 1874, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 122, An act to amend section 12, article 3, of chapter 122, of the Session Laws of 1876, entitled "An act for the regulation and support of common schools," and to repeal original section 12, article 3, of chapter 122, of the Session Laws of 1876, and instruct me to report the bill back to the Senate with the recommendation that it be passed. PRESIDENT: Your Committee on Enrolled Bills, to whom was referred Senate bill No. 298, by Senator Henley, An act extending the provisions of chapter 72 of the Laws of 1886 and amendments thereto, relating to the establishment and maintenance of free public libraries and reading rooms in cities, to the city of Lawrence, have compared the engrossed copy with the enrolled bill, and I am directed to report to the Senate that the same is correctly enrolled, that it has been properly signed by the president and secretary of the Senate and the speaker and chief clerk of the House, and has been presented to the governor for his approval, this 4th day of February, 1903. Senate bill No. 35, An act to amend sections 2 and 24 of chapter 109 of the Session Laws of 1893.

On motion of Senator Noftzger, the bill was amended so as to read "eighteen" instead of "twelve" months.

The question being, Shall the bill pass? the roll was called, with the following result: Yeas 24, nays 7; absent or not voting, 9.

Senators voting in favor of the passage of the bill were: Buschow, Carpenter, Chaney, Crum, Fulton, Henley, Hurrel. Kennedy. McKnight, Miller, Morehouse, Morrow, Noftzger, Pestana, Peterson, Simons, Smith, Sponable, Stewart, Vincent, Ward, White, Wright, and Wulfekuhler.

Senators voting in the negative were: Caldwell, Codding, Gabriel, Householder, King, McMillan, and Tapp.

Senators absent or not voting were: Allen, Branine, Conrad, Cubbison, Findlay, Fitzpatrick, Fullington, Leidy, and Porter.

A constitutional majority having voted in favor of the passage of the bill, the bill was passed, and the title agreed to.

By unanimous consent, Senator Smith presented the report of the Judiciary Committee on House bill No. 160. On motion of Senator Smith, the rules were suspended, an emergency declared, and House bill No. 160 was placed on third reading.

The question being, Shall the bill pass? the roll was called, with the following result: Yeas 25, nays 8; absent or not voting, 7.

INTRODUCTION OF ORIGINAL MOTIONS AND RESOLUTIONS.

Senator Carpenter moved that House bill No. 99 be substituted for Senate bill No. 6, and placed on the Calendar in its place.

The motion prevailed.

Senator Smith moved that House bill No. 182 be substituted for Senate bill No. 173, and placed on the Calendar in its place.

The motion prevailed.

Senate concurrent resolution No. 18 was called.

Senator White moved that Senate concurrent resolution No. 18 be referred to the committee of the whole.

The motion prevailed.

COMMITTEE OF THE WHOLE.

Senator Smith moved that the Senate go into committee of the whole for the consideration of bills on the Calendar under the head of "General Orders." A vote being had, the motion prevailed.

The Senate went into committee of the whole, with Senator Householder in the chair.

After some time spent therein the committee rose, and through the chairman submitted the following report:

MR. PRESIDENT: The committee of the whole Senate has had under consideration bills on the Calendar under the head of "General Orders," and I am directed to report as follows:

Recommend that substitute for Senate concurrent resolution No. 8, Relating to the submission of a proposition to amend section 10 of the bill of rights of the constitution, be passed as amended, subject to amendment and debate.

Also, Senate concurrent resolution No. 9, Proposing an amendment to the constitution relating to juries, be passed.

Also, Senate concurrent resolution No. 2, Relating to appointment of Hon. W. A. Harris a member of the Isthmian Canal Commission, be printed and placed on the desks of the senators.
