The committee appointed on conference of Senate bill No. 992 made the following report:

To the Senate and House of Representatives: Your conference committee on House bill No. 992 have had the same under consideration, and beg leave to submit the following report:

That Senate amendment be stricken out and that original section 2 of the bill be amended by striking out in line 5 the word "governor" and inserting the words "Executive Council." Also, add after the word elected, in the fourth line, the words "and shall take office on the second Monday in January after their election."

After section 2 insert section 3, to read: "Section 3. That section 4 of chapter 286 of the Session Laws of 1901 be amended to read: Sec. 4. No person owning any bonds, stock or property in any railroad company, or who is in the employment, or who is in any way or manner pecuniarily interested in railroads, shall be eligible to the office of railroad commissioner, secretary or stenographer of said board. Said railroad commissioners, secretary and stenographer shall be qualified electors of the state. Said commissioners, secretary and stenographer shall be sworn to the due and faithful performance of the duties of their respective offices before entering upon the discharge of the same. Each of said commissioners shall enter into bonds, with security to be approved by the Executive Council, in the sum of $10,000, conditioned for the faithful performance of his duties.

That sections 3 and 4 of the bill be renumbered 4 and 5, respectively.

That the title be amended by inserting the figure "4" after the figure "2."

And that the bill, as amended, be passed.

House bill No. 982, An act making appropriations for miscellaneous purposes, was read the third time, and the question being, Shall the bill pass? the roll was called, with the following result: Yeas 29, nays 2; absent or not voting, 9.

Senators voting in favor of the passage of the bill were: Allen, Branine, Buschow, Caldwell, Carpenter, Chaney, Codding, Conrad, Crum, Fulton, Gabriel, Householder, Hurrel, Kennedy, Leidy, McKnight, Miller, Morehouse, Morrow, Noftzger, Pestana, Porter, Simons, Sponable, Stewart, Tapp, Ward, Wright, and Wulfekuhler.

Senators voting in the negative were: King and White. Senators absent or not voting were: Cubbison, Findlay, Fitzpatrick, Fullington, Henley, McMillan, Peterson, Smith, and Vincent.

A constitutional majority having voted in favor of the passage of the bill, the bill passed, and the title was agreed to.

MESSAGE FROM THE GOVERNOR.

EXECUTIVE DEPARTMENT, March 11, 1903. To the Senate: I have this day made the following appointment, and submit the name for your confirmation:

W. M. Jones, of Rice county, to be member board of managers of the Kansas State Industrial Reformatory for the term ending April 1, 1905. W. J. BAILEY, Governor.

Senator Porter moved that we do now proceed to the confirmation of the appointment made by the governor. The motion prevailed.

Senator Porter moved that the appointment of W. M. Jones be confirmed by the Senate.

The question being, Shall the Senate confirm the appointment? the roll was called, with the following result: Yeas 31, nays 0; absent or not voting, 9.

The committee of conference on House bill No. 600 offered the following report:

We, your conference committee on the part of the Senate and
House on House bill No. 600, make the following report:

It is agreed that the House concedes all Senate amendments except the following: In line 17, the Senate amendment of 1000 be stricken out and 800 inserted in lieu thereof. On page 8, in the appropriation to the adjutant general, item 7, $12,000 for 1904 and $11,000 for 1905, be stricken out and $10,000 inserted in each place in the Senate amendments.
