On motion of Mr. Allen, a bill of the following title was taken up: A bill to accept a grant of land made to the State of Missouri by the Congress of the United States, to aid in the construction of certain railroads in this State, and to apply a portion thereof to the Pacific Railroad.

Which was read a first time, rule suspended, and read a second

time.

Mr. Grover gave notice that on to-morrow he would introduce a resolution, to amend the twenty-fourth rule of the rules governing the Senate for the present session.

Mr. Allen moved to amend a bill of the following title:

A bill to accept a grant of land made to the State of Missouri by the Congress of the United States to aid in the construction of certain railroads in this State, and to apply a portion thereof to the Pacific Railroad.

Amend the third section of the bill by striking out all after the word "operation," in the third line of said section, and add the following in lieu thereof:

And its receipts shall exceed its expenditures, so as to enable it to. make a dividend; it shall pay into the Treasury of this State annually, a sum of money, which shall be equal to a taxation by the State of its capital stock at its cash value, which shall be as a consideration to the State for the execution of the trust reposed in the State by the Congress. of the United States, and for the purpose of ascertaining when the receipts of said company on its business over and above its expenditures will justify said company in making a dividend, the Governor of this State, or such person as he may appoint, shall at any time after said company commences business, have the right to examine the books of said company, and it shall be the duty of said company to advise the Governor of the fact whenever it is in a condition to make a dividend, Was read a first time.

Mr. Elston introduced a bill of the following title:

A bill to pay James B. McHenry.

Which was read a first time, rule suspended; read a second time, rule further suspended; considered as engrossed; read a third time and passed.

Mr. Allen introduced bills of the following titles:

A bill relating to the Pacific Railroad.

A bill to authorize the city of St. Louis and certain counties and companies to subscribe to the capital stock of the Pacific Railroad, for the construction of a branch to the Iron Mountain and for other purposes.

On motion of Mr. Young, the Senate adjourned until 9 o'clock A M., to-morrow.

WEDNESDAY MORNING, SEPTEMBER 15.

Senate met pursuant to adjournment.

Prayer was offered by the Rev. J. G. Fackler.

Mr. Allen moved to take up a bill of the following title :

A bill to authorize the city of St. Louis and certain counties and companies to subscribe to the capital stock of the Pacific Railroad for the construction of a branch to the Iron Mountain, and for other pur

poses.

Which was read a first time, when Mr. Stewart rose to a point of order, stating that the resolution restricting the business to certain specific objects for the present session would not permit the passage of

the bill.

Which was decided in the negative by the chair.

When Mr. Chew appealed from the decision of the chair, and called for the ayes and noes, which were ordered-and the question being, shall the decision of the chair be sustained? was decided in the negative by the following vote:

AYES-Messrs. Allen, Hudspeth, James, Jones, Lindsay, McCoy, Morriss, Parks, Roberts and Sturgeon-10.

NOES-Messrs. Brooking, Chew, Drake, Dunlap, Elston, Flournoy, Griffin, Grover, Jackson, Rawlins, Reed, Richardson, Robinson, Russell, Stewart, Stout, White, Winston and Young-19.

Mr. Richardson offered the following resolution:

Resolved, By the Senate, the House of Representatives concurring, that when the two Houses adjourn on Saturday, the 18th of September, they will adjourn until the second Monday in December next.

Mr. Jackson moved to amend as follows:

By striking out the words "Saturday the 18th," and insert the words Thursday the 20th.

Mr. Lindsay moved to lay the amendment on the table, and called for the ayes and noes-was decided in the negative by the following

vote:

Mr. Russell moved to amend as follows:

By inserting in place of second Monday in December, the fourth Monday in December.

Which was decided in the negative.

The question recurring on the resolution offered by Mr. Richardson, the ayes and noes were called for, and ordered, and decided in the negative by the following vote:

On motion of Mr. Grover,

Resolved, That the twenty-fouth rule of the Senate be so amended as to allow any Senator to vote upon the Railroad question, which may come before the Senate at this extra session, whether he be a stockholder or not.

Mr. Allen withdrew the amendment offered to a bill of the following title:

A bill to accept a grant of land made to the State of Missouri by the Congress of the United States, to aid in the construction of certain Railroads in this State, and to apply a portion thereof to the Pacific Railroad.

Mr. Allen then offered the following amendment:

Amend after the word "operation" by inserting the following:

And its receipts shall exceed its expenditures, so as to enable it to make a dividend, its capital stock at its cash value, shall be subject to

taxation, not exceeding the tax imposed for State purposes, upon other property at its cash valuation, provided it shall not be subject to taxation, until the expiration of the five years for which said company is exempted from taxation, by its amended charter; for the purpose of ascertaining when the receipts of said company, on its business, over and above its expenditures, will justify said company in making a dividend, the Governor of this State or such person as he may appoint, shall at any time, after said company commences business, have the right to examine the books of said company, and it shall be the duty of said company to advise the Governor of the fact, whenever it is in a condition to make a dividend.

Mr. Young moved the rejection of the amendment, and called for the ayes and noes, which was decided in the negative by the following vote:

On motion of Mr. Flournoy, the amendment offered by Mr. Allen was resumed, the rule suspended, and the resolution read a second time. Mr. Grover moved to strike out the ninth section of the bill. Read a first time, when

Mr. Roberts moved the rejection of said motion, and called for the ayes and noes, which were ordered, and decided in the negative by the following vote :

The rule was then suspended, and the motion read a second time. Mr. Brooking offered the following amendment:

Amend by adding at the end of the first section as follows:

Provided that said Pacific Railroad company shall terminate the said railroad at or near the mouth of the Kansas river in the county of Jackson in this State.

Mr. McCoy offered the following amendment which was decided out of order.

Amend by adding immediately after the word "Congress," where it occurs in the 12th line of section first: "Upon this further condition herein expressed, that said Railroad company shall terminate said. railroad on the western line of the State south of the Osage river."

And further amend by striking out all of the ninth section after the word "State," where it occurs in the third line, and insert the following: "Terminating at or near the mouth of Kansas river, within the county of Jackson; and for the purpose of aiding in the construction of said branch railroad, the Governor shall cause to be issued and delivered to said company, from time to time, special bonds of the State, as a loan of the public credit, to aid in the construction of said branch-the amount not to exceed two millions of dollars, on the like terms and conditions, as expressed in the act of the General Assembly, entitled "an act to expedite the construction of the Pacific Railroad and Hannibal and St. Joseph Railroad. Approved Feb. 22, 1852.”
