PAY AND ALLOWANCES, MEMBERS OF THE ARMY RE-
SERVE ENLISTED PURSUANT TO THE PROVISIONS OF
THE RESERVE FORCES ACT OF 1955

1. Statutory authority. The statutory authority for the payment

of pay and allowances to members of the Army Reserve during the

six-month period of active duty for training is contained in section 262 of the act of 9 July 1952 (Armed Forces Reserve Act of 1952; DA Bul. 7, 1952), as amended by section 2 of the reserve Forces Act of 1955 (DA Bul. 12, 1955). The provisions of this section apply when making payment to these members of the Army Reserve.

2. Pay. a. Monthly pay. Members are entitled to receive pay at the rate of $50 per month during the six month period of active duty for training, irrespective of the pay grade or length of service prior to entry, on active duty for training.

b. Partial payments. Unit commanders are authorized to approve partial payments upon the request of the member concerned. Such partial payments will, in all cases, be in even dollars not to exceed the amounts of accrued pay and allowances at the date of payment, less income tax withheld, if applicable.

c. Advance pay. Members are not entitled to receive an advance

of pay.

3. Incentive pay. Members are not entitled to receive incentive pay for hazardous duty.

4. Leave. Pending decision of the Comptroller General of the United States payments will not be made to these members for the following:

a. Pay and allowances during periods of authorized leave.

b. Lump-sum payment for accrued leave upon release from active duty for training.

5. Allowances. a. Basic allowance for subsistence. Members, if otherwise eligible, are entitled to receive basic allowance for subsistence under the conditions and at the rates prescribed for enlisted members in pay grade E-1 (under 4 months). See AR 35–1460.

b. Basic allowance for quarters. Members are not entitled to receive basic allowance for quarters. In addition, members are excluded from the provisions of the Dependents Assistance Act of 1950, as amended.

c. Travel and transportation. Members are entitled to receive travel and transportation allowances under the conditions and at the rates prescribed for enlisted members in pay grade E-1 (under 4 months). See Joint Travel Regulations.

6. Disability or death resulting from injury or disease. Members are considered to be ordered to active duty in excess of thirty days for the purpose of determining eligibility for the benefits provided by the act of 20 June 1949 (PL 108, 81st Congress; 63 Stat. 201) for disability or death resulting from injury or disease. Entitlement to these benefits accrues under the same conditions and within the same limitations as for other members of the Army Reserve on active

duty for training. See AR 35-1705. During all periods of hospitalization incident to the performance of this six-month period of active duty for training, however, a member is entitled to continuation of pay only at the rate of $50 per month.

7. Retirement, separation, severance pay for physical disability. Members, if otherwise eligible, are entitled to receive the benefits of title IV of the Career Compensation Act of 1949, as amended (disability retirement pay and disability severance pay). Pending decision of the Comptroller General of the United States, the $50 rate of pay will be used for computation purposes. See AR 35-1355.

8. Uniformed Services Contingency Option Act. Members are entitled to make an election under the Uniformed Services Contingency Option Act of 1953, as amended, to provide for payment of an annuity after death in retired status. See AR 35–1365.

9. Death gratuity. The provisions of AR 35–1370 will be applied in making payment of gratuity upon death. Pending decision of the Comptroller General of the United States, the $50 rate of pay, however, will be used for computation purposes.

10. Income tax withholding. The provisions of AR 35-1810 and SR 35-1810-1 are applicable for these members.

11. Collections, forfeitures, fines, etc. See AR 35-1820.

12. Allotments of pay. Members are not authorized to make allot

13. Soldiers' deposits. Members are not authorized to make soldiers' deposits as provided for in AR 35-1550 and SR 35-1550-1. 14. Insurance. Members are entitled to the indemnity coverage (free insurance) authorized by the Servicemen's Indemnity Act of 1951, as amended. (See AR 600-100.) This coverage terminates 30 days after date of release from active duty for training.

15. Reenlistment bonus. A member is not entitled to payment of a reenlistment bonus upon discharge or release from active duty for training and enlistment in a Regular component.

16. Settlement of arrears of pay upon death. See AR 35–1375.

SECTION II

PAY AND ALLOWANCES, MEMBERS OF NATIONAL GUARD PERFORMING ACTIVE DUTY FOR TRAINING FOR SIX MONTH PERIODS

17. General. Members of the federally recognized National Guard of the several States, Territories, and the District of Columbia may volunteer for and be ordered to active duty for training for a six month period under the same program as authorized for members of

the Army Reserve. These members are not restricted to the $50.00 per month pay limitation prescribed in section I. They are entitled, while undergoing such training, to the same pay, allowances and benefits as are authorized for such members of the National Guard while participating in full time training duty under the provisions of the National Defense Act for periods in excess of 30 days according to the grade in which they are serving and under the conditions and at the rates authorized by applicable law and regulations.

18. Restrictions. These members of the National Guard will not be authorized to make allotments of pay or soldiers' deposits or to receive advances of pay.

SECTION III

PAYMENT PROCEDURES

19. Military pay records. Enlisted personnel of the Army Reserve and enlisted personnel of the National Guard participating in six months active duty for training will be paid in accordance with the procedures outlined in the current AR and SR 35-2000 series as modified by these regulations. The Military Pay Record (DD Form 113) will remain open for the entire period of the six months active duty for training and payments made will be charged to the applicable open allotment for Army Reserve or National Guard as listed in the Army Fiscal Code. Personnel being paid under these procedures will, for withholding and income tax purposes, be considered as having been ordered to extended active duty.

20. Initial military pay orders. The Military Pay Order (DD Form 114) prepared to authorize the initial opening of a military pay record will, in addition to other pertinent information, include the following notation in the "reason for change" block:

21. Opening military pay record. The Military Pay Record (DD Form 113) will be opened in the usual manner with the following exceptions:

a. Item 1-Identification. A complete identification of the individual to whom the account pertains will be entered in this space, i. e., service number, pay group number (64 for National Guard and 74 for Army Reserve), name and soundex code, as shown by the following illustration:

Grade, branch or component will not be shown, and the numerical designation of grade in the pay group will be omitted. The same information will be shown in the identification block on the reverse side.

b. Item 2-Status information. The following information will be shown in item 2.

(1) For Army Reserve

c. Item 4—Description of credit items, and amount unpaid last

account.

(1) Under the heading "Description of credit items" the following entries will be made for pay:

(a) For Army Reserve

(b) For National Guard

The appropriate entry in accordance with grade and length of service.

d. Item 8-Code. The following pay record codes will be used in addition to those prescribed in AR 35–210:

(1) Code *61 for basic pay credits and debits.

(2) Code *15 for withholding tax entries (item 23).

*These codes will be prefixed by the digit which identifies the fiscal year designation of the appropriation involved.

e. Item 22-Extra space. In order to readily identify these military pay records from all others, disbursing officers will use this space for further identification: i. e., RES or NG in letters approximately one inch in height.

22. Military pay records extending over two fiscal years. Credit entries. All continuing credit entries will be extended, coded, and closed effective 30 June and reopened effective 1 July.

b. Withholding tax. The withholding tax entry will be extended, coded, and closed effective 30 June and reopened effective 1 July. Entry in item 25, lines 44 and 45 will not be made until the pay record is closed at time of release from active duty.

c. Payments effective 30 June. All personnel paid under the provisions of these regulations will be paid in full (including odd cents) effective 30 June of each year.
