authorities to do, within their refpective counties, ridings, ftewartries, cities, and places refpectively, all fuch acls, matters, and things as fhall be required by his Majefty to be done by them refpectively in the execution of this act, as as they refpectively have to do the feveral acts, matters, and things by law required to be done by them respectively, by any act now in force concerning the militia forces of this 'kingdom.

And be it further Enacted, That all Lieutenants, Deputy Lieutenants, Juftices of the Peace, Conftables, and other officers, and all other perfons, fhall obey fuch orders as they shall respectively receive under the authority of this Act, and the feveral provifions herein contained; and that all perfons guilty of any difobedience to fuch orders, fhall and may be punished for the fame in manner hereinafter

And be it further Enacted, That the Lieutenants or Deputy Lieutenants of the feveral counties, ridings, ftewartries, 'cities, and places aforefaid, within fuch time as they fhall be required by his Majefty fo to do, fhall iffue warrants to the feveral Conftables, Tythingmen, Headboroughs, or other officers, of every parish or place within the feveral counties, ridings, ftewartries, cities, and places aforefaid, to cause returns to be prepared and made touching the feveral purposes aforefaid, or any of them, as his Majefty fhall direct, for their refpective parishes and places; and to caufe true co'pies of fuch their refpe&ive returns to be publicly affixed, in 'fuch manner, and in fuch places, and for fuch time before 'fuch returns refpectively fhall be made, as his Majefty fhall direct; and fuch Conftables, Tythingmen, Headboroughs, and other officers fhall make fuch returns feverally and refpectively 'to the faid Deputy Lieutenants at their refpective fubdivifion 'meetings, according to the warrants which fhall be iffued for 'fuch purpofes, and thall verify the fame upon oath before fuch 'Deputy Lieutenants.

And be it further Enacted, That it fhall be lawful for 'his Majefty, in cafe of actual invafion of this kingdom, or if his Majefty fhall fee fpecial caufe to apprehend that fuch invafion will be actually attempted by the enemy, to autho'rize and empower the faid Lieutenants and Deputy Lieutenants, or any of them, in any emergency, and on the requi'fition of fuch general officers commanding within the district 'refpectively, or of fuch other perfons as his Majefty shall fpecially empower to make fuch requifition, to give all fuch ' orders as fhall be neceflary for the removal of any waggons, 'carts, or other carriages, horfes, cattle, theep, hay, itraw, 'corn, meal, flour, or provifions of any kind, or any other things

things which may be of advantage to an enemy, or useful for the public fervice, and to take the fame, if neceffary, for the public fervice; and alfo to give fuch orders as fhall be neceffary for the removal of the inhabitants of any house, hamlet, district, or place, or any of them, and efpecially fuch as by reafon of infancy, age, or infirmity, or other caufe, fhall be incapable of removing themfelves in cafe of danger, and alfo to destroy, in cafe of neceffity, any waggons, carts, or other carriages, horfes, cattle, fheep, hay, firaw, corn, meal, flour, or provifions of any kind, or any thing which may be of advantage to an enemy; and to take away the ftones from any mill, or otherwife to difable the fame; and to remove or deftroy any black fmith's forge or utenfils, and the utenfils of any other artificers, or any other things which may be useful to any enemy, or which it may be neceffary or advantageous to take or deftroy for the public fervice, and generally to do and act in the premises as the public fervice and the exigencies of particular cafes fhall require.

And be it further Enacted, That if the commanding officer of any corps or company of volunteers, who fhall be appointed under the authority of this Act, or who has been or shall be appointed under the authority of the faid Act of the thirtyfourth year of his Majefty's reign, fhall return any perfon or perfons as ferving in fuch corps or company, for the purpose of receiving any pay, who fhall not actually have appeared and done duty as a volunteer or volunteers, according to fuch return; or if any fuch officer fhall make any falfe return of fuch corps or company, with intent to defraud his Majefty; every fuch officer, on conviction of fuch offence before any juftice of the peace of the county, riding, ftewartry, city, or place where the offence fhall be committed, or the corps or company at the time of fuch conviction fhall happen to be, fhall forfeit and lofe the fum of to be leviedby diftrefs and fale of the offender's goods, in the manner hereinbefore directed with refpect to the penalty before impofed, and for want of fufficient diftrefs, fuch justice is hereby required to commit fuch offender to the common gaol of the county, riding, or place where fuch conviction fhall be had, for any time not exceeding

And be it further Enacted, That it fhall be lawful for his Majefty to authorize any general officer or officers, or other perfon or perfons commiffioned for fuch purpose, to furvey and mark out any piece of ground wanted for the public fervice, and to treat and agree with the owner or owners thereof, or any perfon or perfons having any intereft therein, for the purchase or hire thereof, or for the ufe thereof, for any purpose of defence, or other purpose which the exigence

of the fervice fhall require; and in cafe the owner or owners of any fuch ground, or any perfon or perfons having any intereft therein, fhall refuse or decline to enter into any con'tract touching the fame, or fhall be unable fo to do by reafon of infancy, coverture, or other difability, it shall be lawfuf for the perfon or perfons fo authorized by his Majefty to re'quire or more Juftices of the Peace, or Deputy Lieutenants for the county, riding, ftewartry, city, or place where fuch piece of ground fhall be, to put his Majesty's officers into immediate poffeffion of fuch piece of ground, which fuch Juftices or Deputy Lieutenants fhall accordingly 'do, and fhall for that purpofe iffue their warrant under their hands and feals, commanding poffeffion to be fo delivered, and shall also iffue their warrants to fummon a jury to afcertain the value of fuch piece of ground, and the compenfation which ought to be made for the fame to the feveral perfons 'interefted therein, and to whom the fame ought to be paid, 'the verdict of which Jury fhall be recorded by fuch Juftices or Deputy Lieutenants, and certified by them to the Receivers General of the Land Tax of the county, riding, ftewartry, city, or place where fuch lands fhall lie; which Receiver General fhall, out of any money in his hands, pay fuch com'penfation to fuch perfon or perfons, in fuch manner, and for fuch purpofes, as by fuch verdict fhall be directed: pro'vided always, that no fuch piece of ground fhall be fo taken for the public fervice, without the confent of the owner or owners thereof, unlcfs the neceffity for the fame shall be first certified by the Lord Lieutenant, or of the Deputy 'Lieutenants of the county, riding, ftewartry, city, or place ' in which fuch land fhall lie, or unless the enemy shall have actually invaded the kingdom at the time when fuch piece 'of ground fhall be so taken.

And be it further Enacted, That when it shall be neceffary to take, for the public fervice, remove, or destroy any waggons, carts, or other carriages, horfes, cattle, fheep, hay, 'ftraw, corn, meal, flour, or other provifions, or any other articles whatfoever, or to deftroy or injure any houfe, mill, or other building, or any place of manufacture, or any mtter or thing of value, under the directions aforefaid, it 'fhall be lawful for his Majefty to appoint perfons to en'quire of the value of fuch articles, and the compenfation 'which ought to be made for the fame, by way of purchase or hire, or recompence for dainage, or otherwife, according 'to the nature of the cafe; and if the owner or owners, or 'perfon or perfons interefted, fhall be willing to accept the 'compenfation which fhall be fo afcertained, the fame fhall

be paid by the Receiver-General of the land tax of the county, riding, ftewartry, city, or place, out of any money in his hands, in pursuance of a warrant for that purpose, under the hands of the perfons fo employed to afcertain the fame; and if the owner or owners, or perfon or perfons interested, fhall not be willing to accept fuch compenfation, it fhall be lawful for his Majefty to order Juftices of the Peace of the county, riding, ftewartry, city, or place, to fettle and afcertain the compenfation which ought to be made to fuch owner or owners, or perions interefted; which Juftices fhall fettle and afcertain the fame accordingly, and thall, by warrant under their hands, order the fums to be paid to the perfon or perfons entitled thereto, by the Receiver-General of the land tax of the county, riding, ftewartry, city, or place aforefaid, out of any public money in his hands, and fuch Receiver-General fhall pay the fame according to fuch warrant.

And be it further Enacted, That the Warden of the Stannaries, and all other officers of theStannaries, fhall, refpectively, in obedience to his Majefty's orders to be iuffued for that purpose, procure like returns to be made, and all other matters to be done touching the tinners of the Counties of Devon and Cornwall, according to the cuftoms of the Stannaries and privileges of the working tinners, as are hereby required to be done by the Lieutenants and Deputy Lieutenants aforefaid, touching other perfons refiding in the faid Counties of Devon and Cornwall, not entitled to the benefit of such 'privileges; and fuch Warden and other officers of the Stannaries fhall have fuch and the like powers and authorities to do and execute all and every the matters and things which fhall be fo required to be done as aforefaid, as the faid Lieutenants ‹ and Deputy Lieutenants of the feveral counties, ridings, ftewartries, cities, and places aforefaid, have for doing the feveral matters and things hereby required to be done by them refpec'tively.

And be it further Enacted, That his Majefty's commiffi'oners of Lieutenancy for the city of London, the Lord Mayor of the faid city, and the Aldermen, Deputies, and Common Councilmen of the feveral wards of the faid city and liberties thereof, and the Conftables, Beadles, and other ward officers of the fame, the Conftable of the Tower of London, Lieutenants of the Tower Hamlets, and the Deputy Lieutenants of the faid Hamlets, and their feveral officers, the Juftice of the Peace for the Tower Liberties, the Conftables and other peace officers within the fame, the Warden of the Cinque Ports two ancient towns and their members, his Lieutenant 'or Lieutenants, and his or their officers, and the Mayors, 'Jurats, Juftices of the Peace, Conftables, and other peace of

'ficers for the liberties of the Cinque Ports two ancient towns and their members, and all other Justices of the Peace, Conftables, and other peace officers within their respective dif tricts, and all other perfons having authority within the fame, 'fhall put in execution all and every the powers and provifions 'contained in this Act, in like manner as they are refpectively 'authorized to put in execution the feveral laws refpecting the 'Militia Forces of this kingdom, or any of them within their relp ctive districts.

And be it further Enacted, That the acceptance of any Com'miffion under the authority of this Act, fhall not vacate the 'feat of any Member returned to ferve in Parliament.

And be it further Enacted, That in cafe any perfon fhall 'difobey any orders which thall be iffued in pursuance of this Act, or fhall obstruct or hinder the execution thereof, every 'fuch perfon, upon conviction of fuch offence before any Juf'tice of the Peace of the county, riding, ftewartry, city, or 'place where the offence fhall be committed, fhall forfeit and 'pay the fum of to be levied by distress and 'fale in the manner hereinbefore directed with respect to the penalty hereinbefore impofed; and for want of fufficient diftrefs, or if fuch Juftice fhall think fit not to impofe fuch pe'nalty, then fuch Juftice is hereby required to commit fuch of'fender to the common gaol of the county, riding, or place 'where the offence fhall be committed, for any time not exceeding , and the monies arifing by fuch 'penalty fhall be paid to the treafurer of the county, riding, tewartry, city or place where the offence fhall be committed, to be applied as part of the stock of fuch county, riding, ftewartry, city, or place.

Provided always, and be it Enacled, That if any fuch justice 'fhall not think fit to determine fuch offence, it fhall be lawful for fuch juftice, if he shall see caufe, to commit the person or perfons charged therewith to the next county gaol, there to remain until fuch perfon fhall be delivered by due course of 'law; and if an indictment fhall be found against any such perfon, he or fhe fhall plead thereto without having time to tra'verfe them, as ufual in cafes of mifdemeanors; and being duly convicted of fuch offence, fhall, by order of the court before 'whom fuch offender fhall be tried, be fentenced to imprifon'ment for any term not exceeding months.

And be it further Enacted, That no order or conviction made in pursuance of this Act by any Lieutenant, Deputy Lieutenant, or Juftice of the Peace, fhall be removed by Certiorari out of the county, riding, or place wherein fuch order or con'viction shall be made, into any court whatever; and that no
