Senator Lupfer moved the rules be suspended and an emergency be declared and Senate bill No. 340 be placed on second reading now and referred to Committee on Education and Educational Institutions.

The motion prevailed.

Senate bill No. 321, An act legalizing the Kansas state poultry association, to define certain duties of said association, to make an annual appropriation therefor, and fixing a penalty for the misappropriation of any of the money hereby granted.

Senate bill No. 322, An act to amend section 49 of an act entitled "An act to establish a code of civil procedure," approved October 31, 1868.

Also, Senate bill No. 323, An act to amend section 68 of an act entitled "An act to establish a code of civil procedure," approved October 31, 1868.

Also, Senate bill No. 324, An act providing for a judicial determination of the heirs of an estate of a deceased person, and conferring certain powers on the probate court.

Also, Senate bill No. 328, An act to amend sections 5865 and 5871 of the general statutes of 1889.

Also, Senate bill No. 329, An act relating to proceedings in error from justice courts to the district court, and amending section 566 of chapter 80 of the general statutes of 1889, and repealing said section 566 of chapter 80.

Also Senate bill No. 331, An act to facilitate the sale of

real estate in the state of Kansas by providing for taking and enforcing deeds of trusts for purchase-money.

Railroads:

Senate bill No. 325, An act amending section one of chapter 193 of the session laws of 1889, being an act entitled "An act to amend section 1 of an act entitled 'An act relating to switch connections at the crossings of railroads, and providing for their construction and maintenance,' the same being chapter 133, session laws 1886."

Also, Serate bill No. 326, An act relating to the construction of private switches, side-tracks and spur-tracks, and defining the duties of railroads in relation thereto.

Assessment and Taxation:

Senate bill No. 327, An act relating to taxation and amendatory of section 1 of chapter 110 of the laws of 1893, entitled "An act relating to taxation and redemption, and amendatory of sections 6940, 6976, 6981, 6987, 6988, 6996, of the general statutes of 1889."

Fees, Salaries, and Mileage:

Senate bill No. 330, An act entitled “An act to amend section 4 of chapter 141 of the session laws of 1895, entitled 'An act regulating the fees and salaries of certain named officers of Miami county, Kansas,' and to repeal original section 4 of the session laws of chapter 141 of the session laws of 1895."

Roads and Bridges:

Senate bill No. 332, An act for the permanent improvement of public roads, the construction of storage reservoirs, the waiver of damages by property owners adjacent to such improvements, and providing for carrying into effect the provisions thereof.

Also, Senate bill No. 338, An act relating to road districts, and authorizing and compelling persons between the ages of twenty-one and forty-five years to work' thereon, and repealing chapter 64, session laws of 1893, state of Kansas, entitled "An act to repeal subdivision thirty-four (34), section eleven (11) of article three (3) of

the charter of cities of the first class, published in the general statutes of Kansas of 1889, relating to road districts, and authorizing and compelling persons between the ages of twenty-one and forty-five years to work thereon."

Cities of the Second and Third Class:

Senate bill No. 333, An act to authorize the city of La Cygne to buy, pay for and maintain a park.

Education and Educational Institutions:

Senate bill No. 334, An act to amend section 134 and section 177 of the act for the regulation and support of the common schools.

Also, Senate bill No. 336, An act relating to partially depopulated school districts in counties having a population of less than three thousand.

Committee of the Whole:

Senate bill No. 335, An act providing for the dissolution of school districts in certain cases, providing for procedure therein, and attaching such territory to adjoining school districts, providing for the disposition of property belonging to the disorganized districts, and to provide for the payment of outstanding indebtedness against said disorganized school districts, and repealing chapter 135, session laws of 1893, and all acts and parts of acts in conflict herewith.

Banks and Insurance:

Senate bill No. 339, An act authorizing the county treas urer in counties of less than twenty-five thousand inhabitants to deposit all public moneys in a bank or banks, to authorize the boards of county commissioners of said counties to contract for the payment of interest to said counties on said deposits, and to require bond for the security and repayment of said public moneys, and to repeal chapter 131 of the laws of 1887, chapter 189 of the laws of 1889, and chapter 116 of the laws of 1895.

Ways and Means:

Substitute for House bill No. 222, An act making appropriation to the state normal school for current expenses for the fiscal years ending June 30, 1897, June 30, 1898, and June 30, 1899.

Also, House bill No. 223, An act making an appropriation of certain money for the support of the state normal school.

Also, substitute for House bill No. 307, An act making an appropriation to pay for postage, expressage and freight on the tenth biennial report of the state board of agriculture.

CONSIDERATION OF MESSAGES FROM THE GOVERNOR.

STATE OF KANSAS, EXECUTIVE DEPARTMENT. To the Senate: I have appointed and herewith submit for your confirmation:

On the board of live stock sanitary commissioners: Frank Wineshank, of Kingman county, for the unexpired term of J. B. Vincent; and Taylor Riddle, of Marion county, for the term of three years, beginning March 25, 1897. J. W. LEEDY, Governor.

The message was referred to the Committee on Agriculture and Irrigation.

Senator Reser asked leave of absence for Mr. Stewart, assistant journal clerk, on account of sickness.

CONSIDERATION OF MESSAGES FROM THE HOUSE OF

REPRESENTATIVES.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has passed

House bill No. 110, An act in relation to the competency of husband and wife to testify in divorce cases, and to repeal section 6, chapter 116, laws of 1871;

Also, House bill No. 112, An act to repeal certain sections of chapter 54, general statutes of the state of Kansas, 1889, relating to jury commissioners:

Also, House bill No. 45, An act empowering city clerks of cities of the second and third class to administer oaths.

REPORTS OF STANDING COMMITTEES.

Senator Harris, chairman of Committee on Railroads. submitted the following report:

MR. PRESIDENT: Your Committee on Railroads, to whom was referred Senate bill 196, An act to prevent the removal of journal bearings and other attachments of locomotives, tenders and cars of railroads, and waste or packing from journal boxes of railroad en

gines, tenders and cars and to provide punishment therefor; also, Senate bill 197, An act for the protection of railroad property and to define certain offenses against such property and providing punishments therefor, have had the same under consideration and instruct me to report the bills back to the Senate with the recommendation that the accompanying bill be substituted therefor;

Also, Senate bill No. 199, An act making it a misdemeanor to purchase without proper authority certain railroad supplies, and providing a penalty therefor, and instruct me to report the bill back to the Senate with the recommendation that it be not passed.
