SECOND READING AND REFERENCE OF BILLS.

The following bills were read the second time, and referred as follows:

Judiciary:

Senate bill No. 547, An act repealing section 5, chapter 34, of the Laws of 1903.

Senate bill No. 548, An act to amend section 5228, article 1, chapter 81, of the General Statutes of 1901, being "An act regulating the jurisdiction and procedure before justices of the peace in civil cases.

Senate bill No. 551, An act relating to bonds for public officials, and providing that all counties, cities and townships requiring officers thereof to give bonds shall pay for the same out of their general revenue whenever such bond is given by a surety company authorized to do business in the state of Kansas.

Senate bill No. 557, An act authorizing the board of county commissioners in counties having a population of 25,000 or more to sell, purchase or exchange the county farm or asylum in said county, and to build, remodel or repair the buildings thereon.

Senate bill No. 558, An act concerning jails and jailers' residences, and authorizing their sale under certain conditions.

Senate bill No. 561, An act providing for the compensation of county attorneys in counties having a population of not less than 75,000, providing for the appointment and qualifications of assistant county attorneys in such counties and fixing their salaries, and amending sections 1 and 3 of chapter 200 of the Session Laws of 1903, and relating to the appointment and compensation of deputy county attorneys in counties having a population of 6000, and fixing the salary of such deputy county attorneys.

Senate bill No. 563, An act amending section 5129, General Statutes of Kansas, 1901, relating to liens for labor and material, and repealing said original section.

Senate bill No. 578, An act to amend section 6177 of the General Statutes of 1905, relating to the time and manner of taking appeals in criminal cases, and to repeal said section.

Senate bill No. 579, An act to amend section 6180 of the General Statutes of 1905, relating to the stay of execution in criminal cases, upon taking appeals to the supreme court, and to repeal said section.

House bill No. 177, An act to authorize cities of the second and third class to provide public parks for the inhabitants thereof, and repealing chapter 135 of the Session Laws of 1903.

House bill No. 184, An act for the protection of the furniture and other property belonging to the Hall of Representatives of the state of Kansas, providing a penalty for its violation, and providing for a custodian for said hall.

House bill No. 267, An act to amend section 6513 of the

General Statutes of 1901, granting licenses to ex-Union soldiers and sailors to canvass for and sell goods not prohibited by the law and to operate a delivery- and baggage-wagon in any county or city within the state, and providing penalties for the violation thereof, and repealing the original section 6513.

Whole Senate:

Senate bill No. 549, An act providing for the security of depositors in the incorporated banks of Kansas, creating the bank depositors' guaranty fund of the state of Kansas, and providing regulations therefor and penalties for the violation thereof. Senate bill No. 580, An act making appropriation to pay the mileage and per diem of the presidential electors of Kansas for the year 1909.

Substitute for Senate bill No. 239, An act creating a State Mining Board, and to regulate the employment and qualifications of mine managers, superintendents, pit bosses, hoisting engineer, fire bosses, mine inspector and his deputies, making an appropriation for carrying out the provisions of this act, and providing penalties for the violation thereof.

State Affairs:

Senate bill No. 550, An act providing assistants for secretary of the State Board of Health, and amending section 1 of chapter 380 of the Laws of 1907.

Senate bill No. 567, An act to apportion and disburse certain moneys received from the national government for the counties in the state of Kansas containing the United States forestry

reserve.

Senate bill No. 569, An act to amend section 3, chapter 67, of the Laws of 1903.

Senate bill No. 572, An act to amend sections 1 and 2 of chapter 34 of the Session Laws of 1898, entitled "An act to create a State Society of Labor and Industry, with power to elect a secretary, who shall succeed to the powers and duties of the commissioner of labor statistics and be ex officio state factory inspector, and an assistant secretary, who shall be assistant commissioner of labor statistics, and to collect, report and disseminate statistics of labor and industry, and repealing chapter 186, Laws of 1885, and repealing said original sections 1 and 2 of chapter 34 of the Session Laws of 1898, being sections 6645 and 6646 of the General Statutes of 1901.

Insurance:

Senate bill No. 552, An act relating to life insurance, and to prevent discriminations therein.

Cities of the First Class:

Senate bill No. 553, An act to provide for cleaning or sprinkling, or cleaning and sprinkling, paved streets, avenues or alleys in cities of the first class, and to charge the expense thereof to the abutting property.

Senate bill No. 554, An act relating to cities of the first class, and empowering cities of the first class in the state of Kansas to provide for and maintain public workhouses in said cities, and to provide for the government and maintenance of said workhouses.

Senate bill No. 564, An act relating to and fixing the compensation of the treasurer of the board of education in cities of the first class having a population of over 60,000.

Senate bill No. 565, An act relating to and fixing the compensation of the clerk of the board of education in cities of the first class having a population of over 60,000.

Senate bill No. 566, An act relating to the appointment and compensation of truant officers in cities of the first class having a population of over 60,000.

Ways and Means:

Senate bill No. 555, An act making an appropriation for the purchase of certain lands and coal rights for the use of the State Penitentiary, at Lansing.

Senate bill No. 574, An act making appropriation for the Florence Crittenton Mission, of Topeka.

Senate bill No. 575, An act making appropriation for the Topeka Orphans' Home Association.

Senate bill No. 576, An act making appropriation for the Ingleside Association.

Senate bill No. 577, An act making appropriation for the Topeka Rescue Home.

Assessment and Taxation:

Senate bill No. 556, An act concerning the collection of taxes, amending paragraph 7621 of the General Statutes of 1901, and repealing said original paragraph 7621 of the General Statutes of 1901.

Senate bill No. 570, An act providing for the collection and distribution of highway labor tax, and prescribing the duties of township assessors and other officers in connection therewith.

Manufactures and Industrial Pursuits:

Senate bill No. 559, An act to prevent the adulteration of and deception in the sale of white lead and mixed paints.

Education:

Senate bill No. 560, An act to amend section 1 of article 10 of chapter 122 of the Laws of Kansas for the year 1876, entitled "An act for the regulation and support of common schools."

Claims and Accounts:

Senate bill No. 562, An act making appropriation for and providing for the payment of unpaid salary to J. McCabe Moore, judge of the district court of Wyandotte county, from the 4th day of March 1907, to the 10th day of January, 1909.

Senate bill No. 581, An act making appropriation to compensate W. W. Martin for collecting from the United States government the Spanish war claims of the state of Kansas.

Cities of Second and Third Class:

Senate bill No. 568, An act authorizing any city of the third class to issue bonds to fund its existing floating indebtedness. Congressional and Judicial Apportionment:

Senate bill No. 571, An act apportioning the state of Kansas into eight congressional districts.

Railroads:

Senate bill No. 573, An act relating to railroads and the Board of Railroad Commissioners, and to the construction of side-tracks, switches and other facilities upon the right of way of railroad companies to grain elevators, flouring-mills, warehouses and manufactories located on land adjacent to the right of way of any railroad company in this state, and regulating the making of contracts pertaining thereto, and prohibiting contracts against the consequences of negligence between such railroads and the parties owning and operating such buildings, whether the same are situated upon the right of way of said railroad company or not, and repealing chapter 350 of the Session Laws of 1905, and amending and repealing section 1 of chapter 351 of the Session Laws of 1905.

Roads and Highways:

Senate bill No. 582, An act to enable any county within the state of Kansas to construct certain kinds of public roads, and providing the manner in which and circumstances under which the same may be constructed and the mode of payment of the costs of the construction thereof.

Senate bill No. 583, An act providing for the classification of roads and keeping roads used by rural free delivery routes up to a standard.

REPORTS OF STANDING COMMITTEES.

MR. PRESIDENT: Your Committee on Judiciary, to whom was referred Senate bill No. 421, An act amending section 11, chapter 488, of Session Laws of Kansas of 1905, and repealing said original 'section, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be amended by striking out all that part in parentheses in section 1 down to and including the words "twenty-five hundred dollars," and substituting the following: "That the secretary of the State Board of Agriculture shall receive an annual salary of twenty-five hundred dollars; provided, that when any secretary of the State Board of Agriculture shall have continuously held such office for a period of fourteen or more years, he shall thereupon receive an annual salary of five thousand dollars." The committee is of the opinion that the bill as amended would be clearly within the provisions of our state constitution, but does not understand that it is called upon to express any opinion as to whether or not the amended bill shall be passed. MR. PRESIDENT: Your Committee on Insurance, to whom was referred Senate bill No. 538, An act relating to fire insurance, and to provide for the regulation and control of rates of premium thereon, and to prevent discriminations therein, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be passed.

Also, Senate bill No. 536, An act requiring the superintendent of insurance to pay certain premium money to city firemen and to city firemen's relief and Kansas Firemen's Association, and to amend sections 1 and 2 of chapter 272 of the Session Laws of 1905, and to repeal original sections 1 and 2 of said chapter 272, and recommend that it be not passed. Also, Senate bill No. 356, An act relating to the issuance and countersigning of insurance policies and surety bonds, and recommend that it be not passed, and the following bill be substituted therefor.

Also, Senate bill No. 552, An act relating to life insurance, and to prevent discriminations therein, and recommend that it be passed.

MR. PRESIDENT: Your Committee on Roads and Bridges, to whom was referred Senate bill No. 319, An act concerning roads and road disdistricts, have had the same under consideration, and instruct me to re-, port the bill back to the Senate with the recommendation that it be not passed.

Also, Senate bill No. 425, An act relating to the construction and maintenance of permanent roads, creating districts therefor and a permanent road commission for such districts, with power to levy a tax to pay for the construction and maintenance of such roads, ard authorizing the board of county commissioners to pay for the construction of the culverts and bridges over waterways, and recommend that it be not passed. MR. PRESIDENT: Your Committee on Assessment and Taxation, to whom was referred Senate bill No. 158, An act providing for registration fee on mortgages on real property and for their exemption from taxation after being recorded, regulating the effect of non-payment of registration fee, and prohibiting the enforcement of mortgages upon which registration fee has not been paid as therein provided, and repealing all acts and parts of acts in conflict therewith, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be not passed, the subject-matter being covered by another bill.

Also, Senate bill No. 212, An act providing for a state registration of mortgages of real property, the fees payable therefor, penalties for the non-payment of such fees, the exemption of such mortgages from taxation, prescribing the duties of certain officers, fixing penalties for the non-performance of such duties, and repealing all acts or parts of acts in conflict therewith, and recommend that it be not passed, the subjectmatter being covered by another bill.

Also, Senate bill No. 253, An act to prevent double taxation by deducting certain indebtedness from' the assessment of personal property, and recommend that it be not passed, on acount of its unconstitutional features.

Also, Senate bill No. 338, An act relating to the taxation of the live stock of live-stock dealers and live-stock feeders, and recommend that it be not passed, the subject-matter being covered by another bill.

Also, Senate bill No. 523, An act to amend section 7621, General Statutes of 1901, relating to the payment of taxes, and penalties for nonpayment thereof, and recommend that it be not passed, the subjectmatter being covered by another bill..

Also, Senate bill No. 473, An act relating to the taxation of the property of Young Men's Christian Associations and Young Women's Christian Associations, and recommend that it be passed.
