MESSAGE FROM THE HOUSE.

The following message from the House was received and read:

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has passed House bill No. 177, An act authorizing cities of less than 50,000 population to purchase land and establish parks, and providing for the issuing of bonds and levying tax for the maintaining of the

same.

Also, passed House bill No. 184, An act for the protection of the furniture and other property belonging to the Hall of Representatives of the state of Kansas, providing a penalty for its violation, and providing for a custodian for said hall.

Also, passed House bill No. 267, An act to amend section 6513 of the General Statutes of 1901, granting licenses to ex-Union soldiers and sailors to canvass for and sell goods not prohibited by the law and to operate a delivery and baggage wagon in any county or city within the state, and providing penalties for the violation thereof, and repealing the original section 6513.

Also, has concurred in Senate amendments to House concurrent resolution No. 19.

The same are herewith transmitted.

Senate bill No. 535, An act concerning assessment and taxation, to amend section 84 of chapter 34, Laws of 1876, the same being section 7614 of the General Statutes of 1901, relating to county clerks' duties in the preparation of tax books,

for the purpose of uniformity throughout the state, and repealing said original section 84, chapter 34, Laws of 1876.

Senate bill No. 536, An act requiring the superintendent of insurance to pay certain premium money to city firemen and to city firemen's relief and Kansas Firemen's Association, and to amend sections 1 and 2 of chapter 272 of the Session Laws of 1905, and to repeal original sections 1 and 2 of said chapter 272.

Senate bill No. 538, An act relating to fire insurance, and to provide for the regulation and control of rates of premium thereon, and to prevent discriminations therein.

Ways and Means:

Senate bill No. 540, An act making an appropriation for the Arkansas City Hospital, at Arkansas City, Kan.

Senate bill No. 541, An act making an appropriation for the Mercy Hospital, at Arkansas City, Kan.

Senate bill No. 543, An act asking appropriations for the Florence Crittenton Mission, Colored, of the state of Kansas, at Topeka, Kan., for the fiscal years June 30, 1909, and June 30, 1910.

Cities of the First Class:

Senate bill No. 546, An act relating to the construction of levees through cities of the first class, supplemental to chapter 104, Session Laws of 1893, as amended by chapter 216, Session Laws of 1905.

REPORTS OF STANDING COMMITTEES.

MR. PRESIDENT: Your Committee on Temperance and Hygiene, to whom was referred Senate bill No. 360, An act defining certain duties of the State Board of Health in relation to barber shops and barber colleges, public bath-rooms and public bath-houses, empowering and directing the State Board of Health to make and publish rules and regulations relating thereto, and providing penalties for the violation thereof, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be amended as follows: In section 2, after the words "which rules and regulations shall be," strike out the words "published in the official state paper," and insert in lieu thereof, "in printed form and displayed in a conspicuous place in all places referred to in section 1 of this act." After the word "regulations," strike out the words "when made and published in the official state paper." that it be passed as amended.

Also, Senate bill No. 406, An act to regulate the practice of dentistry, and amending chapter 196 of the Session Laws of 1903, and repealing certain sections thereof, and recommend that it be amended as follows: In section 2, after the words "legal and lawful practice," add the words "of dentistry"; after the words "Examinations shall be," add the words "theoretical and practical,” and strike out "made in whole or part, orally or in writing, at the discretion of the board." In section 3, strike out the following: "All fines imposed and collected under this act shall be paid to the Kansas State Board of Dental Examiners for its use. After the word "falsely" add the word "to." In section 5, strike out "state paper," and insert "statute-book." And that it be passed as amended.

Also, House bill No. 162, An act relating to county health officers, amending section 8 of chapter 129 of the Laws of 1885, and recommend that it be passed. J. A. MILLIGAN, Chairman.

MR. PRESIDENT: Your Committee on State Affairs, to whom was referred Senate bill No. 367, An act providing for the erection of a meraorial and historical building commission, securing a site, and making an appropriation therefor, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be referred to the Ways and Means Committee, on account of the appropriation. Your committee are favorable to the bill if the funds are available.

Also, Senate bill No. 136, An act to prohibit the hiring out of inmates of the State Penitentiary or other penal institutions of the state of Kansas, providing for their employment by the state, and providing for the repeal of all acts in conflict herewith, and penalty for violation of this act, and recommend that it be passed with the following amendments: Strike out in section 1, beginning with the word "provided," "provided, that this act shall not affect contracts for such hire now in force, but no such contracts shall be extended or renewed."

Also, Senate bill No. 260, An act relating to automobiles and motor vehicles, and regulating the speed and operation of the same, and recommend that it be not passed.

Also, Senate bill No. 259, An act to amend chapter 67 of the Laws of 1903, entitled "An act in relation to automobiles and motor vehicles, regulating their speed and operation on the public highways of the state, providing for their proper equipment, and providing penalties for the violation thereof, and recommend that it be not passed.

Also, Senate bill No. 488, An act relating to automobiles, providing for registration thereof and the disposition of the fund so created, and recommend that it be not passed.

Also, Senate bill No. 400, An act in relation to automobiles, regulating speed, license fee, etc., and recommend that it be passed.

Also, House concurrent resolution No. 21, In relation to United States pension agencies, and recommend that it be adopted.

Also, Senate concurrent resolution No. 20, Relating to amendment to appropriation bill for agriculture, and recommend that it be adopted. Also, House concurrent resolution No. 17, Relating to the Eighteenth and Nineteenth Kansas volunteer cavalry, and recommend that it be adopted.

Also, Senate bill No. 81, An act authorizing an annual conference of the state and local boards of health, providing for appointment of delegates and the payment of their expenses for attendance thereon, and recommend that it be passed.

Also, Senate bill No. 489, An act to amend section 8 of chapter 267 of the Session Laws of Kansas of 1905, relating to the protection of fish and game, and to repeal said original section 8, and recommend that it be not passed. EMERSON CAREY, Chairman.

Also, Senate bill No. 98, An act to provide for the appointment of an honorary educational commission to investigate the cost and character of manuscript available for state publication of school text-books, and making an appropriation therefor, and recommend that it be passed.

PRESIDENT: Your Committee on Mines and Mining, to whom was referred Senate bill No. 239, An act creating a State Mining Board, and to regulate the employment and qualifications of mine managers, superintendents, pit bosses, hoisting engineers, fire bosses, mine inspector and his deputies, making an appropriation for carrying out the provisions of this act, and providing penalties for the violation thereof, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be not passed, but that the substitute herewith attached be passed. MR. PRESIDENT: Your Committee on Ways and Means, to whom was referred Senate bill No. 282, An act granting a pension and making an appropriation to George Hatter, of Sedgwick county, Kansas, have had the same under consideration, and instruct me to report the bill back to the Senate with the recommendation that it be not passed, for the reason that an appropriation of $2000 was made to George Hatter in full for the subject-matter covered by this bill, which appropriation act is chapter 17 of the Session Laws of 1903.

Also, Senate bill No. 231, An act to establish at the Kansas State Agricultural College a division of forestry, under the direction of the Kansas Experiment Station, and appropriating funds for the support of same, and recommend that it be amended as follows: In section 4, line 3, after the word "of," strike out the figures "$4000" and insert in lieu thereof the figures "$1000"; line 4, strike out the figures "$10,000" and insert in lieu thereof "$1500"; line 5, strike out the figures "$10,000” and insert in lieu thereof the figures "$2500." In section 6, strike out "all acts and parts of acts conflicting herewith are hereby repealed" and insert in lieu thereof the following: "That chapter 405 of the Session Laws of 1907 is hereby repealed." And your committee further recommends that the title of said act be amended to read as follows:

An act to establish at the Kansas State Agricultural College a division of forestry. under the direction of the Kansas Experiment Station, and appropriating funds for the support of same, and repealing chapter 405 of the Session Laws of 1907.

And your committee further recommends that said bill be passed as amended.

Also, Senate bill No. 499, An act making appropriations for the Forestry Stations at Dodge City and Ogallah, Kan., for the fiscal years ending June 30, 1909, and June 30, 1910, etc., and recommend that it be not passed, for the reason that the subject-matter thereof is covered by Senate bill No. 231, heretofore recommended by your committee.

Also, Senate bill No. 367, An act providing for the erection of a Memorial and Historical Building Commission, securing a site, and making an appropriation therefor, and recommend that it be not passed.

Also, Senate bill No. 164, An act to establish a state department of forestry, providing for the appointment of a state forester, his term of office, duties and compensation, and recommend that it be not passed, for the reason that the subject-matter thereof is covered by Senate bill No. 231, heretofore recommended by your committee.

Also, Senate bill No. 233, An act to establish a State Forestry Commission, a state forester, prescribing the duties thereof; to encourage the planting and growing of forest-trees in the state of Kansas, making an appropriation therefor, and to repeal certain acts and parts of acts in conflict herewith, and recommend that it be not passed, for the reason that the subject-matter thereof is covered by Senate bill No. 231, heretofore recommended by your committee.

Substitute for Senate bill No. 239 was read the first time. By unanimous consent, Senator Huffman moved that the rules be suspended, that Senate bill No. 421 be considered engrossed, that an emergency be declared, and that the bill be placed on third reading, subject to amendment and debate, which motion prevailed.

Senate bill No. 421, An act amending section 11, chapter 488, of Session Laws of Kansas of 1905, and repealing said original section, was read the third time.

Senator Stannard moved that the bill be referred to the Committee on Judiciary, with instructions to prepare a measure that will, if possible, secure a salary of $5000 per year for the office of secretary of agriculture during the incumbency thereof of F. D. Coburn, and no longer, and that the report of the committee be made by four P. M. to-morrow, which motion prevailed.

COMMITTEE OF THE WHOLE.

Senator Glenn moved that the Senate go into committee of the whole for the consideration of bills on the Calendar under the head of "General Orders." A vote being had, the motion prevailed.

The Senate went into committee of the whole, with Senator Chapman in the chair.

After some time spent therein the committee rose, and through the chairman submitted the following report:

Recommend that House bill No. 79, An act amending section 6, chapter 386, Laws of 1907, and making appropriation therefor, be passed over and retain its place on the Calendar.

That Senate bill No. 146, An act to provide for better protection of people who assemble in public halls, hotels or public houses of entertainment, lodgings, tenement-houses and other public places, and appointing a state superintendent of inspection, and repealing certain laws, be passed over and retain its place on the Calendar.

That Senate bill No. 214, An act to enable counties, townships and cities to purchase and use voting-machines at all general, special and primary elections; providing for the payment thereof; creating a Kansas
