MESSAGE FROM THE HOUSE.

MR. PRESIDENT: I am directed by the House to inform the Senate that the House has passed House bill No. 247, An act to prohibit employees of the Legislature from lobbying with the members thereof, and providing for penalties for violations of this act.

Also, passed House bill No. 297, An act making appropriation for postage, express, freight, packing and other expenses of the distribution of the Sixteenth Biennial Report of the State Board of Agriculture.

Also, passed House bill No. 298, An act making an appropriation to the Crosby Brothers Company for the payment of the purchase of desks, chairs and carpet furnished the House of Representatives, session of 1909, and for freight and drayage thereon.

Also, adopted House joint resolution No. 3, Recommending the calling of a convention to revise, amend and change the constitution of the state of Kansas.

Also, amended, and passed as amended, Senate bill No. 42, An act to amend section 3 of chapter 471 of the Session Laws of 1905.

Also, passed House bill No. 18, An act in relation to persons hiring conveyances from livery-stables who fail and neglect to return the same to the owner thereof in fair condition, and providing a penalty for its violation.

Also, passed House bill No. 87, An act to amend section 3 of chapter 246, Session Laws of 1907, entitled "An act to license vendors of drugs, medicines, nostrums, ointments or appliances of any kind for the treatment of diseases, injuries or bodily defects, and for the enforcement thereof, and further providing for the fees for licenses and the disposition thereof," and repealing said section 3.

Also, passed House bill No. 252, An act relating to procedure to take evidence in suits brought to enforce the laws of this state against unlawful monopolies, trusts and combinations in restraint of trade, and suits to enforce laws regulating and controlling corporations.

Also, passed House bill No. 47, An act prohibiting the sale of any fruittree or fruit-trees of a certain kind, variety or description and the delivery thereafter with the intent to deceive to the purchaser of a fruit-tree or fruit-trees of a different kind, variety or description, and providing penalties for the violation thereof, and prescribing the time within which prosecutions under this act may be commenced.

Also, adopted House concurrent resolution No. 15, Relating to the acceptance of the deed to Pawnee Rock.

The same are herewith transmitted.

PRESENTATION OF PETITIONS.

The chair laid before the Senate twelve telegrams and letters urging the passage of Senate bill No. 141, which were referred to the Committee on Ways and Means.

INTRODUCTION OF BILLS.

The following bills were introduced and read the first time: By Senator Chapman: Senate bill No. 260, An act in relation to automobiles and motor vehicles and regulating the speed and operation of the same and other vehicles on the public streets and highways in the state, and providing penalty for the violation thereof, and for the repeal of chapter 67 of the Session Laws of 1903.

By Senator Potter: Senate bill No. 261, An act making appropriation to the Bethesda Hospital, Goessel, Kan., for the fiscal years ending June 30, 1910, and June 30, 1911, and providing for its visitation, inspection and supervision.

Also, Senate bill No. 262, An act making appropriation to the Industrial School and Hygienic Home for Friendless Persons, at Hillsboro, Kan., for the fiscal years ending June 30, 1910, and June 30, 1911, and providing for its visitation, inspection and supervision.

By Senator Myers: Senate bill No. 263, An act for the protection of quail.

By Senator Robertson: Senate bill No. 264, An act to establish a board of commissioners for the promotion of uniformity of legislation in the United States, and making an appropriation to pay the expenses of said commission.

Also, Senate bill No. 265, An act relating to sales of personal property.

By Senator Bender: Senate bill No. 266, An act authorizing a bounty for the destruction of crows, and to repeal chapter 74, Session Laws, 1905.

By Senator Leidy: Senate bill No. 267, An act to amend section 7568, General Statutes of 1901, providing for changing the time of listing real property for assessment and taxation from even- to odd-numbered years, beginning with the year 1909, and repealing original section 7568, General Statutes, 1901, the same being section 43, article 10, chapter 107, relating to taxation.

By Senator Moore: Senate bill No. 268, An act concerning captions to proposed constitutional amendments.

By Senator Avery: Senate bill No. 269, An act making appropriation to the Clay Center Hospital Association, of Clay Center, Kan.

By Senator Porter: Senate bill No. 270, An act to amend section 125 of chapter 122 of the Laws of Kansas of 1903, being "An act relating to cities of the first class, and repealing chapter 37 of the Laws of 1881 and all acts amendatory and

supplemental thereto in so far as the same relate to cities of the first class," and to repeal said section 125.

By Senator Price (by request): Senate bill No. 271, An act defining the liability of employers of labor within the state of Kansas in cases of injury or death to their employees, and repealing all acts or parts of acts in so far as they conflict herewith, and no farther.

Senate bill No. 233, An act to establish a state forestry commission, a state forester, prescribing the duties thereof, to encourage the planting and growing of forest trees in the state of Kansas, making an appropriation therefor, and to repeal certain acts and parts of acts in conflict herewith.

Senate bill No. 246, An act to establish a state fair in the state of Kansas, and to provide for the management and the maintenance thereof, and making appropriations therefor.

Corporations:

Senate bill No. 234, An act to amend section 5, article 2, chapter 23, General Statutes of Kansas, 1901, the same being an act entitled "An act concerning private corporations."

Judiciary:

Senate bill No. 235, An act to amend paragraph 5763, General Statutes of Kansas, 1901, the same being section 325 of chapter 82 of the General Statutes of Kansas, 1868, entitled "An act to establish a code of criminal procedure."

Senate bill No. 236, An act to amend section 34 of article 2 of chapter 68 of the General Statutes of 1901, the same being section 4249 of said statutes, and repealing original section 34.

Senate bill No. 237, An act to amend section 4229 of the General Statutes of 1901 of the state of Kansas, and requiring the clerk of the district court to enter a settlement of judgment on mortgages in the office of the register of deeds.

Senate bill No. 238, An act amending section 4009 of the General Statutes of 1901, and repealing said original section, an act in regard to marriage license.

Senate bill No. 240, An act relating to liability of employers in mining industries in certain cases.

Senate bill No. 242, An act to repeal chapter 210 of the Session Laws of 1907, entitled "An act to provide for the payment of an under-sheriff in counties having more than 18,000 population and less than 25,000 population."

Senate bill No. 245, An act to prevent drinking of intoxicating liquors on passenger-trains in this state, to authorize

conductors to make arrests therefor, and to provide penalties for the violation of this act.

Senate bill No. 247, An act providing for a registration fee on mortgages on real property, and for their exemption from taxation after being recorded, regulating the effect of non-payment of registration fees, and prohibiting the enforcement of mortgages upon which registration fees have not been paid as herein provided, and repealing all acts and parts of acts in conflict herewith.

House bill No. 246, An act to define and classify lobbyists and lobbying, to regulate the employment and registration of legislative lobbyists, to provide for the filing by lobbyists of a verified statement of expenses and obligations, and prescribing penalties for the violation of the provisions of this act.

Senate bill No. 250, An act concerning the public schools in the city of Wichita, Kan., a city of the first class, and repealing the following acts, to wit: Chapter 227 of the Laws of A. D. 1889, chapter 349 of the Laws of A. D. 1901, chapter 427 of the Laws of A. D. 1905, and chapter 339 of the Laws of A. D. 1907. Senate bill No. 254, An act to restrain township and city officers from speculating in their offices.

Senate bill No. 255, An act amending section 5129, General Statutes of Kansas, 1901, relating to liens for labor and materials, and repealing said orignal section.

Senate bill No. 257, An act to amend section 2068, the same being section 77 of chapter 31, article 3, of the General Statutes of Kansas of 1901.

Senate bill No. 258, An act to amend section 6513 of the General Statutes of 1901, granting licenses to ex-Union soldiers and sailors to canvass for and sell goods not prohibited by the law, and to operate a delivery and baggage wagon in any county or city within the state, and providing penalties for the violation thereof, and repealing the original section 6513. State Affairs:

Senate bill No. 256, An act relating to the deposit of public moneys and funds in hands of county treasurers in national and state banks in Kansas.

Senate bill No. 259, An act to amend chapter 67 of the Laws of 1903, entitled "An act in relation to automobiles and motor vehicles, regulating their speed and operation on the public highways of this state, providing for their proper equipment, and providing penalties for the violation thereof."

Live Stock:

Senate bill No. 241, An act creating the office of state veterinarian, and designating who shall be the state veterinarian.

Senate bill No. 248, An act pertaining to the detection of glanders in horses, asses and mules.

Education:

Senate bill No. 243, An act concerning high schools.

Railroads:

Senate bill No. 244, An act to establish maximum rates for the transportation of illuminating oil, gasoline, fuel oil and crude petroleum, to forbid rebates, and to provide penalties for the violation of the provisions of this act, and repealing chapter 353 of the Session Laws of 1905 and all acts or parts of acts in conflict herewith.

Senate bill No. 249, An act providing for the safety of persons in charge of shipments of live stock on railroads, and requiring the railroad company to provide way-cars or cabooses on live-stock trains to their final destination.

Whole Senate:

Substitute for Senate bill No. 15, An act providing for depositories in which shall be kept the funds of cities of the second and third classes, and also the school funds of the public schools in such cities.

Cities of the First Class:

Senate bill No. 251, An act to amend section 139 of chapter 122 of the Session Laws of 1903 of the state of Kansas, entitled "An act relating to cities of the first class, and repealing chapter 37 of the Laws of 1881 and all acts amendatory and supplemental thereto, and chapter 82, Laws of 1897, and ali acts amendatory and supplemental thereto, in so far as the same relates to cities of the first class," and to repeal said section 139.

Assessment and Taxation:

Senate bill No. 252, An act concerning townships, limiting the rate of taxation in townships, providing for depositing money belonging to townships, and directing the disposition of interest on money belonging to the townships, and repealing section 8 of chapter 362 of the Laws of 1905.

Senate bill No. 253, An act to prevent double taxation by deducting certain indebtedness from the assessment of personal property.

Mines and Mining:

Senate bill No. 239, An act creating a state mining board, and to regulate the employment and qualifications of mine managers, superintendents, pit bosses, hoisting engineers, fire bosses, mine inspector and his deputies, making an appropriation for carrying out the provisions of this act, and providing penalties for the violation thereof.
