said nineteenth section of the act of June twelve, eighteen hundred and fifty-eight, as is inconsistent with this act, be, and the same is hereby, repealed: Provided, That the volumes shall average not less than one thousand pages: Provided, further, That the whole amount expended in the publication of these volumes shall not exceed three hundred and forty thousand dollars."

Mr. Ellihu B. Washburne moved that the vote by which the 38th amendment as amended was agreed to be reconsidered, and also moved that the motion to reconsider be laid upon the table; which latter motion was agreed to.

Mr. Francis W. Kellogg moved that the rules be suspended, so as to discharge the Committee of the Whole House from the further consideration of the bill of the Senate (S. 30) for the relief of Sheldon McKnight, and to enable the House to consider the same.

Pending which, the yeas and nays having been ordered thereon, On motion of Mr. Sherman, at 10 o'clock p. m., the House adjourned.

The following petitions and memorials were laid upon the Clerk's table, under the 24th rule of the House, to wit:

By Mr. Otero: The petition of citizens of the Territory of New Mexico, praying Congress to retain Fort Craig as a permanent military post in its present locality; which was referred to the Committee on Military Affairs.

By Mr. Curry: The petition of Dyer T. Blythe, of Alabama, asking remuneration for arresting Henry H. Sutton, charged with felony; which was referred to the Committee of Claims.

By Mr. Woodson: The memorial of S. P. Keller, praying damages for non-fulfilment of contract on the part of David B. Mitchell, formerly a superintendent of Indian affairs.

By Mr. Mallory: The petition of citizens of Louisville, Kentucky, praying for a change of mail arrangements between Louisville and Cincinnati; which was referred to the Committee on the Post Office and Post Roads.

By Mr. Singleton: The petition of J. Hendebert, praying for compensation for services rendered as consul at Lyons; which was referred to the Committee of Claims.

By Mr. Potter: The petition of Elizabeth McAllister, widow of Andrew McAllister, praying for a pension; which was referred to the Committee on Revolutionary Pensions.

By Mr. Pennington: The memorial of the Historical Society of Pennsylvania, in regard to the publication now being made by order of the British government of a calendar of the early history of America; which was referred to the Committee on the Library.

A message from the Senate, by Mr. Patton, one of their clerks: Mr. Speaker: The Senate have passed a bill of this House of the following title, viz:

H. R. 500. An act making appropriations for the naval service during the fiscal year ending the 30th of June, 1861;

with sundry amendments; in which I am directed to ask the concur rence of this House.

On motion of Mr. Sherman, by unanimous consent,

Ordered, That the said bill of the House No. 500, with the amendments of the Senate thereto, be referred to the Committee of Ways and Means, and that it be made a special order at and after 2 o'clock p. m. this day.

On motion of Mr. Crawford, by unanimous consent, Ordered, That leave be granted for the withdrawal from the files of the House of the papers in the case of Samuel S. Rind.

The above-mentioned papers were thereupon delivered to the petitioner.

Mr. Davidson, from the Committee on Enrolled Bills, reported that the committee had examined and found truly enrolled a bill of the following title, viz:

H. R. 521. An act to incorporate the "East Washington Library Association."

The Speaker having announced as the regular order of business the motion of Mr. Francis W. Kellogg, and pending when the House adjourned yesterday, to suspend the rules, so as to discharge the Committee of the Whole House from the further consideration of the bill of the Senate (S. 30) for the relief of Sheldon McKnight, and to enable the House to consider the same.

The House proceeded to the consideration of the said bill.
Pending the question on its third reading,

Mr. Maynard moved to amend the same by adding at the end thereof the following, viz:

"Provided, That the sum allowed by virtue of this act shall not in anywise exceed forty five thousand dollars."

Pending which,

Mr. Francis W. Kellogg moved the previous question; which was seconded and the main question ordered, and under the operation thereof the said amendment was agreed to, and the bill ordered to be read a third time.

It was accordingly read the third time.

The question then being on its passage,
