A majority having voted in the negative the motion did not prevail.

Mr. Brandley moved that the vote by which the motion to lay upon the table was lost be reconsidered. The yeas and nays being demanded, the roll was called with the following result: Yeas, 14; nays, 12.

Gentlemen voting in the affirmative were: Messrs. Brandley, Ely, Guerin, Johnson, Judd, Matheny, Moonlight, Morrill, Rogers, Simons, Simpson, St. John, Topping, and York.

Gentlemen voting in the negative were: Messrs. Butler, Barker, Crichton, Edwards, Grimes, McFarland, Murdock, Price, Schmidt, Wilson, J. C., Wilson, V. P., and Winter.

A majority having voted in the affirmative, the motion was adopted.

Mr. Winter moved that the Senate do now adjourn, which motion did not prevail.

Mr. Price moved a call of the Senate, which motion did not prevail.

The question being upon the motion to lay upon the table, the yeas and nays were demanded and the roll was called with the following result: Yeas, 13; nays, 12.

Mr. Edwards asked and by unanimous consent obtained leave to offer Senate concurrent resolution No. 46, "Relative to adjournment sine die," which was laid over under the rules.

Mr. Edwards moved that the rules be suspended and Senate concurrent resolution No. 46 considered now, which motion prevailed, and Senate concurrent resolution No. 46, "Relating to adjournment sine die," was taken up for consideration.

The question being upon the adoption of the resolution, a vote was had and the resolution adopted.

Ordered that the Secretary inform the House thereof.

MESSAGES FROM THE HOUSE.

The following message from the House of Representatives was received and read:

MR. PRESIDENT: I am directed to inform the Senate that the House of Representatives have adopted the report of the committee of conference on House bill No. 353, an act entitled "An act to provide for the appointment of regents, directors and trustees for the control of the public institutions of the state, and defining certain powers thereof."

MR. PRESIDENT: Your committee on enrolled bills, to whom was referred Senate bill No. 88, "An act to regulate and fix the terms of court in the fifth judicial district," have had the same under consideration, and I am directed to report the said bill to the Senate correctly enrolled, and have presented the same to the Governor for his signature.

MR. PRESIDENT: Your committee on enrolled bills, to whom was referred Senate bill No. 56, "An act authorizing Montgomery county to issue bonds to pay the indebtedness of the county," have had the same under consideration, and I am directed to

report the said bill to the Senate correctly enrolled, and have presented the same to the Governor for his signature.

Mr. Price moved that the Senate do now resolve itself into committee of the whole for the consideration of bills on the calendar, upon which the yeas and nays were demanded, and the roll was called with the following result: Yeas, 14; nays, 11.

On motion, the Senate resolved itself into executive session for the consideration of messages from the Governor.

MESSAGE FROM THE GOVERNOR IN EXECUTIVE SESSION.

The following message from the Governor was received and read:

To the Senate: I have the honor to submit the following nominations for your action:

For Ajutant General Kansas militia, C. A. Morris; for Paymaster General Kansas militia, Wm. Baldwin; for Quartermaster General Kansas militia, Samuel Lappin.

On motion, the nominations of the Governor were confirmed, and the Secretary instructed to inform His Excellency of the Senate's action.

MESSAGE FROM THE GOVERNOR IN EXECUTIVE SESSION.

The following message from the Governor was received and read:

TOPEKA, March 6, 1873.

To the Senate: I hereby nominate Homer C. Learned, of Woodson county, for director of the penitentiary to fill the vacancy caused by the resignation of Harrison Kelley. I also nominate A. J. Angell, of Leavenworth, for director of the penitentiary, vice E. Hensley, whose term expires March 3, 1873. THOMAS A. OSBORN, Governor.

On motion, the nominations of the Governor were confirmed, and the Secretary instructed to inform His Excellency of the Senate's action.

On motion, the executive session was dissolved.

This bill is in effect a re-enactment of a part of House bill No. 234, "An act supplemental to 'An act to provide for the auditing of, settlement and assumption of the Price raid claims of 1864, and Indian expedition under Major General Curtis, in July and August, 1864,' approved February 19, 1869," and is
