Mr. Murdock moved that the Senate resolve itself into committee of the whole for the consideration of appropriation bills, which motion prevailed.

After some time spent therein, the committee arose and through its chairman made the following report:

MR. PRESIDENT: Your committee of the whole Senate have had under consideration House bill No. 387, "An act making appropriations for miscellaneous expenses," and I am directed to report the said bill to the Senate with the recommendation that it be passed as amended.

House bill No. 395, "An act making appropriations for completing the eastern portico of the state house, and for the care and improvement of the state house grounds," and recommend that it be passed.

House bill No. 59, "An act to appropriate money to erect an east wing to the state insane asylum," and recommend that it be passed as amended.

House bill No. 389, "An act making appropriations for expenses of investigation," and recommend that it be passed as amended.

THOS. MOONLIGHT, Chairman. On motion, the report of the committee of the whole Senate was agreed to.

MESSAGE FROM THE HOUSE.

The following message from the House of Representatives was received and read:

House bill No. 367, "An act to amend section 3 of chapter 88, laws of 1870."

House bill No. 362, "An act to provide revenue for the years 1873 and 1874."

Senate bill No. 153, "An act for the protection of prairies from incursions by fire."

Senate bill No. 31, "An act to vacate town sites and additions thereto," and has stricken from the calendar Senate bill No. 154, "An act relating to state roads in the counties of Bourbon, Neosho and Wilson."

Senate bill No. 112, "An act to authorize the incorporation and establishment of loan and trust companies."

Senate bill No. 84, "To expedite the collection of costs in justices' court," and has refused to concur in Senate amendments to House bill No. 402, "An act to legalize roads and highways in Bourbon county, Kansas."

Mr. Murdock moved that the Senate do now resolve itself into executive session, which motion prevailed.

The following message from the Governor was received and read:

STATE OF KANSAS, EXECUTIVE DEPARTMENT,
TOPEKA, March 5, 1873.

To the Senate: I have the honor to submit the following nom

inations for the action of the Senate: For major general Kansas militia, Samuel Walker; for brigadier generals Kansas militia, Percy Daniels, F. H. Drenning, Robert McMillan, and H. C. Snyder; for surgeon general Kansas militia, W. H. Earley; for aides-de-camp, with the rank of lieutenant colonel, Cyrus Leland, Wm. Burgoyne, and George W. Peck; for assistant adjutant general, with the rank of major, H. T. Beman.

THOMAS A. OSBORN, Governor. On motion, the nominations were confirmed, and the Secretary of the Senate directed to inform the Governor of the Senate's action.

On motion, the executive session was dissolved.

Mr. Butler moved that the House be requested to return to the Senate House bill No. 277.

Mr. St. John moved that the motion be laid upon the table, upon which the yeas and nays were demanded, and the roll was -called with the following result: Yeas, 14; nays, 12.

Gentlemen voting in the affirmative were: Messrs. Brandley, Crichton, Ely, Guerin, Matheny, Moonlight, O'Neil, Palmer, Rogers, Simons, Simpson, St. John, Topping, and York.

Gentlemen voting in the negative were: Messrs. Blair, Butler, Barker, Edwards, Johnson, Judd, McFarland, Murdock, Price, Schmidt, Wilson, J. C., and Winter.

Gentlemen absent or not voting were: Messrs. Grimes, Martin, Martindale, McWirt, Morrill, Walker, and Wilson, V. P.

And so, a majority having voted in the affirmative, the motion prevailed.

Mr. Ely moved that the vote by which House bill No. 253 was passed be reconsidered.

Mr. Price moved that the motion be laid upon the table, which motion prevailed.

House concurrent resolution No. 39, "Relating to a territorial government in the Indian Territory," was laid over under the rules.

House bill No. 362, “An act to provide revenue for the years 1873 and 1874," was read the first time.

Mr. Brandley moved that the rules be suspended, and all House bills just read the first time be read the second time now, which motion prevailed, and House bill No. 403, "An act to amend section 1 of an act entitled 'An act amendatory to an act entitled an act for the assessment and collection of taxes,' approved March 3, 1869," was read the second time and referred to the committee of the whole Senate.

House bill No. 405, "An act to amend section 36 of an act incorporating cities," was read the second time and referred to the committee of the whole Senate.
