House bill No. 335, "An act to legalize the sale of certain school lands in the town site of Independence," was read the third time, and the question being, Shall the bill pass? the roll was called with the following result: Yeas, 15; nays, 5.

And so, a constitutional majority not having voted in favor of the passage of the bill, the bill did not pass.

Mr. Price asked and by unanimous consent obtained leave to introduce Senate bill No. 163, "An act in relation to the extension of the corporate limits of cities and towns," which was read the first time.

Mr. Price asked and by unanimous consent obtained leave to introduce Senate bill No. 164, "An act to provide for the issuance of duplicates of certain Union military scrip," which was read the first time.

Mr. Price moved that the rules be suspended, and the bills juct introduced be read the second time and referred now, which motion prevailed, and Senate bill No. 163, "An act in relation to

the extension of the corporate limits of cities and towns," was read the second time and referred to the committee of the whole.

Senate Bill No. 164, "An act to provide for the issuance of duplicates of certain Union military scrip," was read the second time and referred to the committee of the whole Senate.

Mr. Price moved that the rules be suspended, and Senate bill No. 163 considered engrossed and read a third time now, which motion prevailed, and Senate bill No. 163, "An act in relation to the extension of the corporate limits of cities and towns," was read the third time, and the question being, Shall the bill pass? the roll was called with the following result: Yeas, 17; nays, 0.

Gentlemen voting in the affirmative were: Messrs. Blair, Brandley, Barker, Grimes, Judd, McFarland, Moonlight, Morrill, Murdock, Price, Rogers, Schmidt, Simons, St. John, Topping, Wilson, V. P., and Winter.

Roll called. The following gentlemen were present and answered to their names: Messrs. Blair, Brandley, Butler, Barker, Edwards, Ely, Grimes, Guerin, Judd, McFarland, Moon

light, Morrill, Murdock, O'Neil, Price, Rogers, Schmidt, Simons, St. John, Wilson, V. P., and Winter. Quorum present.

Prayer by the Chaplain, Rev. F. S. McCabe.

The journal of Saturday was read and approved.

Mr. St. John asked and by unanimous consent obtained leave to offer Senate concurrent resolution No. 44, "Relating to certain bribe money," which was laid over under the rules.

Mr. Brandley moved that the rules be suspended, and Senate concurrent resolution No. 44 taken up for consideration now, which motion prevailed, and Senate concurrent resolution No. 44, "Relating to certain bribe money," was taken up for consideration.

Resolved by the Senate, the House concurring therein, That the President of the Senate and Treasurer of State are hereby authorized and required to employ counsel in defending the suit now pending, in which J. Q. Page is plaintiff and the President of the Senate, E. S. Stover, and the Treasurer of State, J. E. Hayes, are defendants, to recover $7,000 alleged to have been paid by S. C. Pomeroy to A. M. York.

Mr. Butler moved that the resolution be laid upon the table, upon which the yeas and nays were demanded, and the roll was called with the following result: Yeas, 8; nays, 4.

And so, a majority not having voted in the affirmative, the motion did not prevail.

The question being upon the adoption of the resolution, a vote was had and the resolution adopted.
